Just tell the creditors you are doing an IVA and that you have been advised not to pay. However, there is absolutely NO RULES to say you can't provide a token payment in the meantime as goodwill on you part...it is all upto you...

There was someone here who had a IVA passed and not paid over 5 months prior...but it went through but I would not have done that myself....he had spilt decison who went towards his favour.

Hi couple 31

Welcome to the forum. And good luck on your plans [:)]

In my experience the very fact that you are dealing with things through the proper channels puts you in a position of power over your creditors, so don't stand any nonsense! ... you are doing things the correct way.

I had one phone call from a creditor when I was going through my IVA last year when I politely explained what was happening ... they took absolutely no notice and engaged in a tirade of threats. From that one call I arranged call divert to my mobile which has caller display and did not answer ANY calls for which i did not recognise the number.

I suspect that, like you, I am a professional person with a business to run ... I am addressing my debts thank you very much and I haven't got time for phone calls like these, I have better things to do ... that was the attitude I adopted and it seemed to work well for me [:)]

All the best

Debbie

Many thanks for the advice, it's much appreciated

Hopefully, we can get this wrapped up in a maximum of 2 months, I'm just waiting on First Direct to send me the last 6 months bank statements and then it is all ready to be returned to the IP

Quick query regarding possible new car

My car is on it's last legs. Having a reliable car is essential for my work (travel to a lot of meetings)

My father has offered to get me a new(used) diesel (worth about 5k) when he sells their family jeep

If the car he buys is registered to him and he simply 'lends' it to me for x years as a named driver on the insurance, then presumably that doesn't have to be declared as an asset of mine in the IVA application?

I did suggest he might like to put 5k towards the debt mountain but he said he'd rather help out with something like that

Thanks

Only my opinion and would wait for other answers but I would not see it being a problem as you would not be the registered keeper and the car is basically being lent to you.

Hello couple31

There wouldn't be a problem with those car arrangements in an IVA, as aguise says, but your IP may ask for evidence that the car belongs to a third party ie your father

Thank you both very much for your help.
