Next - sold debt!!

Hi Everyone,
My IVA was agreed at a creditors meeting in April, how ever today
I recieved a letter from Lewis Debt Recovery for the Next Directory Debt (which was included in my IVA). It threatens Court proceedings, CCJ's and demands immediate payment! Money I don't have thank you.
I phoned my company and was advised that if it was representing Next not to worry, but if the debt had been sold on it would have to be included in my IVA!
This is for the experienced and experts - am I at risk of having to pay two peolpe for my debts? As in if they sell them on do I become responsible for them all over again which means I will pay twice?
Sorry to ask another question, but I can't afford to have the debt continually growing after I think I've sorted it.....
Also say my Doctor today and have more happy pills - he's pleased with my progress and supports my move back to home in Bristol!!!
I'm taking the job (although lower paid back near home - I#ll save on petrol so hopefully can maintain my payments. I have to fill out a new I & E form when I do make the move so thank you for all your support - I may soon be a happy bunny!!!)

Chardonney...just send it to your IP.Some firms seem to take longer than others.It happened to be and i went into panic mode and was advised on this forum to send it all off.It stopped happeninfg when the infomation caught up.What 'happy pill's are you taking? Cat

Chardonnay, pleased about the news on the job, I'm sure you will be loads happier in Bristol and will probably be able to stop taking the happy pills!

As Cat says, pass it on to your IVA company and let them deal with it. As far as I am aware you will only pay for your debt once. All mine were sold on and I have had no threatening letters at all.

Thanks Everone,
I've spoken to B & E and they told me to ignore it -easier said than done!! For those who don't know my happy pils are antidepressants to stop me attempting suicide (I only got one weeks worth to start with). My G.P today has entursted me with 1 months worth of pills before my next review - at the end of July. Thankfully they support me in the fact that I need to move home and they've given me a direct line to CRUISE for counselling.

Send the letter to your IP and ask them to respond on your behalf. They are legally bound by your IVA so they cannot take any further action against you.

case of left hand not knowing what the right hand is doing. If your in a IVA, they will most likely sell on the debt to another company, usually eversheads / max recovery.

They will then get any dividend under the IVA. They cannot register any CCJ against the debt as it is included in your IVA

Pass it all on to your IP. Also would like to wish you luck with the new job.

Just goes to show how distressing these kind of letters can be for people, enough to tip people over the edge.

Glad to hear that you have made a decision on the move Chardonnay.

You will not have to pay towards this debt ouside of the IVA as it will be included.This type of thing is fairly common but you have nothing to worry about

Hi All

I still get letters from companies that have brought my debts 3 years in at first i got into a panic but just sent them on to IP now the letters do say THIS IS JUST FOR INFORMATION but it still makes my heart skip a beat.

Hold in there Caerrie things will start to look brighter for you keep taking the tablets and speak to the counselors at Cruise re your loss. In a few years years this will be a dreadful nightmare. Wishing you well in your new life

My doctor has given me a number for Cruise - i'm arranging for counselling to start when I move back home. The help & support from this site is so great.

I misread your post and thought your doctor had recommended a cruise for you to go on,and wondered if this was allowed during an IVA!!
Keep taking the happy pills for as long as the doctor suggests,they really can help(wife is a mental health nurse)(I'am mental!!)
Ignore the letters,IP's get paid handsomely to help deal with these,so let them.
