hello everyone, thanks immensely for all the kind words and thoughts, yes i have had a 2 tough weeks and have been up to Scotland and down to London.

update on niece, thanks to rainbows advice, she has been given temp accommodation, she has managed to get her stuff out of the house over the last 2 days, social are also fighting her corner, she has also been in touch with shelter who are helping her and put her in touch with a womans refuge centre who are going to give her counselling with the mental abuse, she appears to have actually woken upto the situation and seems to be getting stronger and moving forward, she has been very grateful for all the help, i haven't had the chance to talk to her about maintenance yet as we only got back from Kent late last night, but will keep you updated.

sorry i wasn't able to give an update before, but so many things seem to be happening at the mo, thanks lily and melanie for your kind words and postings.

he is staying at his brothers as far as i know, he had to be at the house whilst it got emptied but niece has allowed him to take nothing as most of the furniture was in her name and she needs it for new house, she has told him that it is all over, other than that until i speak to her, tonight thats all i know on him, at present.

thanks ang, update, a council house has become available around the corner from her mum today, she has applied straight away for it, she has been told she has 40 points, is this good Rainbow? so fingers crossed she gets it and out of the temporary accommodation.

Hi Kerri

Really pleased to hear from you and that you are OK. Sorry to hear about all the things you have been through though, but glad it has made your neice stronger - Have the Council arranged to store the furniture for her?

With regard to the 40points she needs to ask "What are the current points that families are being allocated on?"
The Government introduced legislation to state that famlies should not be kept in temp accommodation (B&B)or for as short as time as possible and for no longer than 6 weeks.
Is she currently in B&B or a house/flat that the Council are using as temp accom?
Has the Council carried out their investigations yet? Has she had a letter from them stating that they have completed their investigations and that they have accepted a duty towards her?
Can she got a copy of their allocation policy?

I don't want to put a damper on things but unless there is no shortage of accommodation in her area! I wouldn't hold out much hope of her being allocated that property....I sincerely hope I am wrong - If Shelter are still helping her get her to call them and ask them to pile on the pressure to the Council that this house would be excellent for her IE support is at hand from her mum and family, the children know the area etc. Get her to get a letter from her Doctor stating that she needs support and settled accommodation as a priority - Contact her MP anybody that she can think of that will write and support her.
You said that Social were also fighting her corner do you mean Social Services or Jobcentre? If Social Services get them to contact the Council as well pleading her case.
I'm sorry to be so unclear but I cannot find a copy of their housing policy on their website (Which should be displayed and she is entitled to a copy and should have been given one)
Once she has got some of the answers to the questions - The Homeless and Allocation policy is the most important document I can advise further.

hi rainbow sorry in the delay to get back to you, here goes, shelter put niece in touch with a woman's refuge who have taken over everything even down to dealing with the council, everything they are doing is exactly what you have stated its called woman's aid, they are pushing for this council house because of the kids and it is the area they have grown up in, woman's aid are paying for everything and claiming it all back off the council as you said its what they should be paying, they have taken everything out of her hands, they have all the paperwork,from the council, she is in temp accommodation arranged by them as it is near her mums and the council only offered B+B so they again are charging this to the council, everything they are doing is exactly what you told my niece to do, social security are also sorting what money she is entitled to, things work very different in wales for some reason and she is doing not too bad, we are going tomorrow to sister in laws for a get together to cheer everyone up, had bad news again tonight in regards to mum in law who has taken a turn for the worse, but other sister doesn't want anyone to go to kent as yet, she is being a bit not to nice at the mo, she has hit us today with she has had a lawyer in to gain power of attorney, so she can have access to the mums bank accounts, i asked why she couldn't get a third party form from the banks as we had to do this with my gran, any how when we receive the letter off the solicitor tomorrow i will probably be posting asking questions on that, she is being very awkward at the mo, as mum in law stays with her, nothing is ever easy is it, but i am ok trying to take a back seat in everything to keep myself sane, what a rotten year but it will soon be over and 2008 will hopefully be so much better, will stop rambling now, thanks to everyone for all the help on this especially rainbow, will keep you all updated and hopefully fingers crossed she will get this house and start a fresh.

Hi Kerri

Thanks for the update and I am pleased to hear that you are taking a back seat! PROTECT yourself and you do appear to be having a really tough year, it will get better - I believe that every thing happens for a reason just sometimes we don't know what and its really hard going.

It appears that your neice is in good hands so take a step back from that and let Womans Aid help her through this time, they have an excellent reputation and I am sure that they will do everything they can for her.

I am sorry to hear about your mum-in-law - With regard to going to Kent I would go if I wanted to regardless of what sister-in-law wants and would be asking questions as you say.

Keep Strong and look for the positives (There will be some along the way!)

Sending you all positives thoughts have a good time at your other sister in laws Knees Up.

in the meantime you can direct her to the homes scheme, if she works in the borough she lives in or has a relative there she should be eligiable for the scheme.

There is no point opting for a borough that has a shortage of housing, as your nomination is likely to be refused. A borough will only accept a nomination if there is a realistic chance of making you an offer.

Turning down an offer from another borough will not affect your application for housing with us.
