Hi all,

I have had an IVA for 19 months now. However, I did not have an annual review after 12 months and I have now moved house (tenant). I have not as yet contacted my IP (mainly as I am worried that I will need to have review and my salary has jumped up twice since I started the IVA...)

I now have 2 main questions:

1. Is it my IP's responsiblity to contact me about a review or should I be prompting them?

2. Can my finances be 'back-dated' at all and so in effect I would therefore end up oweing even money to my creditors as I may have been able to pay more over the last 6 to 12 months?

Any general/overall advice on thie would be most appreciated,

Thank you!

Hi there and welcome to the forum

It is your IP's responsibility to contact you with regard to your annual review, but it is your responsibility to keep them informed of changes of address. How do you feel they can contact you if they do not know wheter you now live?

Depending upon the terms of your IVA, and any creditor modifications which were put forward at your creditors meeting and accepted by you, may well mean that you owe money to the IVA - so best to contact your IP soonest to put him/her in the picture.

I assume you had informed the IVA company that you had move. I'll be surprise if you didn't?? As for the payrise, in so far as they are inflationary increases I don't think you need to worry.Your I/E would have gone up as inflation rages on.

Creditors normally want a yearly report on debtors, and it is unlikely your IP has forgotten if they are still taking money, as IP are paid to maintain your case till the 5 year is up.
