Good Morning can anyone advise, we are going to see a solicitor this morning for some free advise regarding a problem we have, if they decide to take on our case could this be done on a no win no fee bases, i'm not sure how this works, does anyone know if they apply for credit/insurance to apply for the no fee part, i am shortly to complete my iva, and my OH's is still being sorted.

Unless you are going to one of the 'no win, no fee' lawyers who advertise on TV, then you will have to ask when you go.

I'm not sure how they work but I wouldn't think your IVA will make much difference.

Depending on what your problem is, I would say that any money you get would have to go towards your IVA.

I am sure that an expert will come along and either confirm this or put you right!

If you are shortly to complet your IVA and could possibly get some windfall cash,can you not put off making a claim(be careful that there is not a time limit as to when you can make your claim by)
Discharged today the 8th feb 2012. View is much brighter now.

I am wondering whether she means that she is due a creditors meeting?
I only ask because it sounds as though her husbands proposal/creditors meeting is still to be arranged.

I could be wrong though.........

Kallis3 & Plasticdaft we have been to solicitors this morning but only spoke to a junior solicitor who didn't deal in litigation, so she is to pass on our case to another solicitor in the pratice on monday, she didn't know if we could get no win no fee bases so will have to wait till monday, i was bothered in that the creditors report on my iva states no credit allowed and i didn't/still don't know how no win no fee works, do they take out some form of credit or insurance to cover their work. This will be a major claim if to go ahead!!! to try to clarify, my HO and i agreed a f/f last year and my is due to be completed july 08, now my OH had a major hiccup with his iva so this has resulted in a further creditors meeting.

I think the firms all work in different ways with regards to no win no fee,but do know that one company who advertised on the tv said that they dont get you to sign any credit agreement,I just cant remember which company it was.

Hi There,
I can tell you about the ones that advertise on Tv:
They will look at your evidence and decide whether or not to take you on
There is quite a lot of work involved gathering evidence, in my case photo's, receipts, etc
Once you get near a court date - for accidents/injury that is about three years later, they take out insurance which will cover you if your claim fails - it wipay Court costs, the other sides fees, etc.
I have a cse that should come to court around September time after I slipped on a wet tiled floor in a Multi-storey car park and fractured my skull with four brain haemorrhages (Bristol Royal Infirmary told the other half I wasn't going to be leaving hospital alive, but I'm still here to prove them wrong!!)

Thanks everyone - I've not had the luckiest of lives have I??!! My frend, who trained as a hypnotherapist, is going to do a past life regression on me to see if my problems stem from a previous existence - apparently problems in this life are often related to past lives and you can go back and sort them out!!
My solicitor hopes I should get double figures of thousands for my injury (20+)- most of it will be for pain and suffering so the IVA cannot take it - mind you I intend to use all I can to help clearing my debt. I may keep enough a holiday (haven't had one of those for over three years and there's no hope of one with the IVA!!) and pay back friends, etc who have helped me getting the IVA up and running.
I'm lucky in one way - in that I'm still here and some good mews is the Alopecia Society are going to help with my confidence - they provide wigs, hair pieces, etc which I want as I'm still very concious of the bald patch on the back of my head where the removed a large piece of scalp, complete with all the hair follicles!!!
Wish me luck....I'll soon have a full head of hair!!!!

Chardonnay, you certainly have been through the mill! I admire your courage that you have come through a stronger person.

Don't know whether I could do the past life regression thing - sounds too scary!

Didn't realise though that the IVA couldn't take your money. I thought anything you had over £500 you had to hand over to them. You go and have a good holiday - you deserve it![:D][:D]

Hi Jan,
I've been told that the pain and suffering money can't be taken as it's compensation for what I went through, Still I'm planning to use it to reduce my debt - every little helps as they say!!
The past life regression is OK- it's like hypnotherapy, you're in a state of deep relaxation and know what is happening around you - it's not like those hypnotists who have you doing silly things!! My friend has had a couple during her training and it's fascinating - she tried before but it was my first session and I had already met & said goodbye to loved ones who have passed away - It was quite emotional and the past life didn't work as no-one came "from the other side" to giude me!! (I think that was down to me as when it came to my twin and dad instead of letting thm go all I could say was I wanted them back!!)
I'll let you know how my next session goes!!

I'll let you know. Nicky (the hyotherapist) has been a man in all her regressions - this appears to be her first life as a woman - the detail she gives is fascinating!!
I'm really curious to see what/who i've been before!!
