Isn't that just typical ... just when it looked as if everything was going so well ... creditors meeting due on Monday (21st April) ... offering the same 25p in £ as my creditors would have got under the IVA ... and at the 11th hour the Inland Revenue put in a claim for £4,000 and vote "no" ... but I don't owe them any money ... they actually owe ME £529 ... and, that old chestnut, "The Landlord" has out in a claim for £36,000!!!! This now raises my total debt from £140,000 to £170,000 so the funds I have available will now be less than 20p in £

Looks like I need to start getting some ducks in row for BR [:(]

Oh Debbie thats awful.. but I don't understand.. if you don't owe them anything why would they vote No? Are you not still in your IVA, and could you not just carry on with that if so?

Oh Debbie how awful for you after everything you have already been through.
I do hope you get this sorted out soon then you can put an end to the whole lot and get on with your life without the stress.

It's a bit more complicated than that unfortunately Ang. My original IVA didn't include the Landlord which means that my original IVA had to fail ... indeed, I am completely confused myself now!

Oh Debbie, I am very sorry to hear this..

Please don't give up hope as Andy says 20p in the £ is a lot better than creditors would gain through bankruptcy so they may think logically.

I really do hope after all you have been through with this process you get a positive outcome - It's what you deserve![:)]

Maybe Mr C can put the 'frighteners' on the creditors....LOL
Be positive & look after yourself, there are more important things in life than debts....

Just been looking at the figures again and I can't quite remember how you work it out about votes going to 75% but the biggest creditors are;

Lloyds £42,000 who didn't vote in the IVA
Landlord £36,000 who I would imagine would vote in the variation
Max £31,000 who Melanie seemed would vote positively ... perhaps having paid so little for the debt

Clutching at straws I know ... is this how you work it out?

Hi Debbie - 2 points:

The landlords claim - does any of it relate to future rent, which would be mitigated upon re-letting the property? If not, has he already re-let it and, if so, is the £36k the correct claim value.

Secondly - how is the HMRC claim made up, in view of your remarks?
