Hi, hoping for some advice.
I renewed my o2 contract at the beginning of this year and it was another 24 monty contract with new handset.
Myself and my husband entered into an iva in may of this year, and two weeks ago o2 put a complete bar on my phone and when I contacted them they said it was because they had been informed I was in an iva.they said I needed to go onto a pay as you go sim card, which I agreed to. The lady I spoke to said they wouldnt need me to return the handset and I would get a credit for the month ahead. Well I have just had a bill for £555 from them, and theyve billed me for the remander of the 24 month contract.
Im really at a loss at what to do, if they're the ones who have cancelled my contract am I liable to pay? I know of other people with o2 who are in iva's and havent had to end their contract.

Strange, I've been with O2 for over 10 years, been in my IVA for over 4 years, in that time I've had new phone contracts, upgrades, signed up to their broadband service, never had any problems. Only difficulty was when I wanted to sign up to their line rental and they had to do a credit check, which inevitably I failed.
I can't see any basis for them behaving in this way - if you had been complying with the terms of your mobile phone contract what right have they got to suddenly end that contract ?. And under what basis can they charge you for the whole contract ?.

Hi this has now been resolved, my iva company contacted o2 directly and theyve confirmed I do not have to pay the remainder of the contract. Their system automatically produce a bill once a contract ends.

That's strange - both me and my partner work for O2 and have several contracts with them in our names (for us and family) and haven't heard anything from them regarding the IVA.
I wasn't even aware this was their policy - how did they even find out? Did you miss any payments?
Surely the only people that could inform them would be your IVA company - and I'm not aware of any reason why your IVA company would inform them, unless they have another company doing a PPI claim on your behalf and they've just sent letters to every account on your credit file looking for PPI. I've heard some companies do this, they don't even bother to look which are credit cards, loans or other accounts! They just fire letters off to every account on there in the hope of hitting the jackpot.
I don't think anyone would have the right to inform them unless you were very behind with your payments or your IVA company refused to let you have a mobile phone, which is unlikely. I would be furious if this happened to me. Glad it was sorted for you but there's something not right about all this.

I've never had any issue upgrading or any problems with 02 since I have been in my IVA.

If they have billed you for the rest of the contract then they at least will have to give you a service that reflects that bill. If they have already cut you off then I think you will not have to pay it. The only thing I can suggest is have a chat with your IP see if they have any ideas. Outside of that is legal advice or the CAB maybe.
