well all i said i would let you know how i got on, here goes:

the house will be sold, we will have up to 2 yrs here which we knew, the property part goes to a seperate trustee so will know more about the BI when he takes over.

hubby can keep his car as over 10 yrs and of no real value, mine will go but they are not allowing me provision for one as there is public transport, i don't know how they worked that one out as i have 3 kids to see to as well as disabled parents, it will mean leaving the house at 7.30 and arriving home at 7 so will have to rely on others for the kids which is not going to be feasable in the long run, it also means their football will have to stop as i will not be able to take them when hubby is away so really feel for them when i have to explain all this.

My income and expenditure was far too low he said, i had put down 650 per month for family of 5 he said this was a bit excessive and would normally only allow 500 i explained that i had included school lunches and also provision for my husband needing to have money to feed himself whilst away so that was acceptable and he allowed me the 650, he allowed all the utilities and insurances that i had put down, he disallowed, contingency fund of 50, sky at 25, kids football clubs 31, and supplies for computer at 20, however my clothing allowance per month i had set at 50 and he said come on be realistic you have 3 growing kids i am setting that at 200 per month, he also said the holiday fund at 50 was to low and would only equate to 600 for famuly of 5 per year, ( i took my figures from insolv site) he said we are looking in the region of 1500 per year so i am upping that to 200 also which means with all the changes we were left with a surplus of 56 so he said no IPA so that was good news also.

i was in there for 1 1/2 hrs, they interview you seperately but he allowed me to stay in with hubby as he only took 10 mins as he was happy with my narrative and would be using that for both of us, what i would advise is they ask you what you spent the money on so make sure you are prepared to answer that one especially on the bigger loans and your figures add up, he also asked in one sentence how did i become BR and was there anything specific, said the reduction of tax credits but he said that was not acceptable and guided me in my answers so basically i said because we lived above our means, an he said that is why everyone is made BR so that was ok, it was not an interrogation and was all very friendly, he said he wanted no paperwork off me, they like to take as little as poss both our pensions are fine as they are not due to be paid out until 2012, and that was it, he doesn;t think he will need to interview us again, we will hear off them in 3 months to redo I/E and that was it.

so apart from the car everything was fine he is telephoning me in regards to the car as i gave wrong reg plate last week must have been nerves, to see its value but i will not be allowed to keep it, so as of now i have no way of getting to work when hubby away.

it was shattering but i am so glad its all over

Well done Kerri. A difficult day I am sure but on the road now to being free from all the worry. Sorry about the car but maybe within a month or two you could by a banger just to get you around. Our car is really old and we keep a watch in the auto trader website just to keep touch of what is going cheap and there are some good cars on there with mot etc, so bear that in mind. He seemed very fair over income and expenditure. Glad you dont have to make any payments.

Hi Kerri, I'm sorry to hear about the car and house. I'm surprised that they wouldn't let you keep a car if you can't get to work when Jack is away. I was under the impression that if you needed a car for work that you would be allowed to keep it, even if you had to sell yours and get a cheaper one. I was allowed to keep mine as even though there is public transport I would struggle to get to work on time. I'm also surprised as your parents are disabled. My friend was told that if her son was disabled she could have kept her car.

thanks ang, i am so glad its all over and today is the start of a new life, a new debt free life for me and my family, it has been hard going these past few months but i am so glad i have closure, i know its daft about the car i am just worried i won't be able to get to work, but we will have so much money each month now that your right i may be able to buy something sooner, its just that with the car i have now meant i was able to take mum and dad everywhere with me.
it is such a huge relief its hard to explain how i feel knowing now the creds can't tuch me and out of it all there will be roughly 20k shared out to them, but i am sure the OR will take his fees first so they will get very little back as compared to my rejected IVA.

skip he said it was because there was adequate public transport apparantly and i only live 7.5 miles away from my work, but i did feel he didn't look at the bigger picture in regards to seeing to the kids also as, although the schools have breakie and after school clubs they don't open or close late enough for me, said parents being disabled made no difference, so i my self was quite shocked, thought he would take it but at least allow me a car of sorts.

Your right today is the start of your new life as a debt free individual. I’m sorry to hear that you can no longer transport your children and parents around when needed.

May I ask how much your car is worth?

I'm only about 5 miles from work so there doesn't seem to be any guidelines. Saying that, it would take me 45 minutes by bus and I couldn't get there on time so I don't know if that had anything to do with it. As Ang says you might be able to get a banger to get you around - that was what I planned to do if the OR had taken my car.

I'm glad you've finally got it sorted though - I think the waiting was actually worse than the OR interview itself!

I am so sorry about the car, I just wanted to say you have been so brave about it all and have stood tall throughout. After being ripped off by the scumbags at synergi, your journey has been difficult. You came, you tried and you did everything possible, not only to hold on to your home but also to pay your creditors back. I for one admire your courage and I really think you deserve to move on and be happy. I have been with you since the beggining and even though you have been through all this you still had time for me. You have been a life line to me and I thank you for that.

Your story has made me cry as I know how hard it has all been for you. I am so glad its all over for you also.

oh, sorry to hear about your car, I know its only a peice of metal but its independence too!!! I know I won't be allowed to keep mine when I petition for bankruptcy, its worth about £9000 but I just hope I can get a cheaper one! I have 3 kids too and work is not that far away but we live on the outskirts of the town and it would be 2 buses to get to school and work and there is no way I could be there on time. I have decided if the OR takes my car, I would give up work, but maybe I could get an old banger for a couple of hundred quid, is this allowed???? Does the OR check up and would I get into trouble?

Seems the OR was generous with other expenses tho, I didn't know you were allowed a holiday fund, I thought holidays were a thing of the past!

At least you know where you stand now and can move on!

oh lily you made me cry, but i think i needed to.
i am always here for you and anyone else, if i can steer people and help them in the right path then i will, its been a hard 10 months and something i wouldn;t like any body else to face.

jane as long as you are not buying the car on credit then i see no reason for you not to be able to do that, he said to me that they are not there to make our lives difficult and put us in a position were we could not live realistically, don't forget to put haircuts,medical, dental, car tax/ins, holidays down i believe some OR's are lenient than others and may allow sky, i was allowed my internet connection also, he said everyone is entitled to a holiday.

iva experts my car i valued it on AA as in need of repair because it needs a new cam belt so valued it at 4400, my OR uses a site called parkers by the way for their valuation if anyone needs to get a valuation, i went on there when i got home and they valued it at 5800 so there will be no chance but then again they do auction the cars so will go a lot cheaper than that.

Hi Kerri,

sorry about the car as you said it seems no guidelines, i only got to keep mine because of the HP and the OR cannot make a claim on the car but my finance company had stated that should i miss one payment for the remainder then they will reposses the car i still have 1.5 years remaining.

As for the house again sorry it has to go. I am looking forward to renting as i will never have to pay for maintenance again :-) or buildings insurance etc.

Hi girls out of interest as you say the OR lets you stay in the house for up to two years do you continue to pay the mortgage in that time, might be a daft question but I have always rented and dont know much about property etc.
I also must say that I have never regretted the fact that I rent as there are advantages to both I agree but I rent with a housing assocation and its nice not to have the extra costs of repairs ,exterior painting etc the only thing you get more standard stuff but we have a knock at the diy and change the things we dont like obviously to the extent that we are allowed, but we just had a new bathroom and all I had to pay for was the shower (because there wasn't one before) andf its lovley nto to have the repair prssure or the dread of something going wrong.

yes you still have to pay the mortgage ang, or the mortgage provider will repossess, maybe when you find somewhere else then you stop paying while you get enough money to move.
