OR phoned today

me and hubby had our phone calls today with the OR he went through everything and says we do not have any payments to make, thankfully and as our house is in negetive equity it should be safe. we need to get valuation and redemption figure and get a third party to but interest in property. its such a relief to get it over with it took about one and a half hours but he was very nice. he also said as i need my car for work it should be exempt as only worth about £2900 but hubby car is worth about £5000 so they will take it and allow him up to £2000 as he needs it to get to work. looking forward to the future now. just hope not to many other people have seen the ad in the paper.

Try not to worry about the notice in the paper, it's been in now and won't go in again,

This post ought to be also put on the bankruptcy forum, as an OR is Exeter is trying to keep £3,100 from a car without making any allowance at all. There is absolutely no consistency in the Insolvency Service at the moment in regard to things like this.

It does seem very open to interpretation of the OR which is very unfair, but I have also formed the impression that unless you have the knowledge and guts to 'question' what the OR says, you can be very much be on the receiving end of a harsh stick!

I was allowed to keep my car which was worth around £3-3.5k, although it needed a lot of work doing to it.

yes it does seem very unfair, it seems to be the luck of the draw in regards to which OR you get surely there should be a standard that they all work on. i must say our was excellent very understanding and reasonable.
