Well what a strange situation.
I think you may have been too honest
I really can't see the OR realising much money from the camera,video camera and the golf clubs.To be honest by the time the fees are paid to pick up and sell the car they won't see much money from that.
It'll be interesting to read Mels view on this

I must admit that I didn't declare my camera - I didn't even think about it. It was bought on a credit card but the OR hasn't asked me about it (yet). I did look on Ebay and you could get exactly the same model for less than £100 as it is now obsolete so I don't know if that has anything to do with it.

I did list my laptop, but it was never mentioned. It isn't in great condition as I dropped it, but I have heard that because I don't have a letter exempting it they may decide they want it. I haven't rung the OR to query it as last time I did that I ended up with all sorts of problems!

Mick, I don't know if it would be worth talking to someone higher up the foodchain about this as it seems as if the person you are dealing with is a bit of a jobsworth to say the least.

Yesterday is history, tomorrow is a mystery, today is the present - a gift to make the most of.

I would like some advice on what I should offer or should I say the 3rd party be offering to buy the Items back. I have no Idea what would be exceptable to the agent of the OR. If I could get some Idea on what they would sell for perhaps I could be able to get a freind to make the offer for me.

Or will the agents of the OR tell me a price they will except for the Items?

You can make an offer to the OR. I would have a look on the internet to find out the prices of things and then start low. Don't forget the OR has to arrange the collection and pay auction fees so don't offer your top amount to start with.

Have a look on ebay,that will give you a fair idea.Offer less than they fetch on ebay to take into account collection and selling costs.
I would guess that your creditors will see none of the proceeds

Incredible! At a time when the OR's attitude to surplis income is (in my opinon) far too relaxed, I find it difficult to believe what I am hearing here. Which OR's office are you dealing with? And if all of this is correct, you are definately a victim of your own honesty and this will not encourage future posters to mention such items again on their own applications.

Dig in and fight this. I have over a hundred bankruptcy cases in my cupboard where these sort of items would not have been taken.

the only thing i could add to this is find out where they will auction them and go and buy them back i have read this on other forums and they have bought there own goods back for a few pounds, like the others have said you have been too honest in declaring your assets, i also know of one other person who listed their CD collection and the OR took it, i am so sorry things didn't work out today, and very sorry about the car, they do seem to be coming down hard on cars if they aren't used for work, they did with mine even tho it was used for work, i hope everything works out for you.

I have to say that I too am amazed at this post.

I would suggest that you ask the OR to obtain a valuation and offer to buy at that price. I can't believe it would be in the OR's interest even to arrange a valuation.

Sounds to me like you've got an over enthusiastic examiner but, out of interest, which OR's office is it?

I am gobsmacked at all this! I cannot believe you are losing all of this!

Out of interest, in this sort of situation is it possible to appeal to a higher person/authority to appeal something like this? I know UPINSMOKE said losing the small items are not much hassle, but the car being taken away seems crazy at only £800 with no MOT!!

I can only reiterate what the others have said - I can see why they would take your car as you don't use it for work - but I hope you have upped your I&E to reflect the increased costs that you would incur by having to use public transport. But I can't believe that they would seize goods which have little real value (except to yourself). Does make you wonder if being completely honest is the best policy. What next? They take your microwave because you already have the use of an oven????? Unfortunately it seems with OR's it's just a postcode lottery. But if you want to keep your things, and it sounds like you really need your car - then do the research yourself and put foward an offer to the OR. Your car would only raise a few hundred at auction but to you it's invaluable.

Thanks for all your support, It has now hit home what is going to happen. After reading all threads on this forum on BR I thought that I would be ok with the fact that I was honest and up front with the things I listed. But it seems that they have got it in for me.

The OR who is dealing with this is in Brighton. Is there anyway I can appeal against their decision in any way. The car is my main concern as it my only form of transport that I am allowed to drive. I have a Full Motor Cycle licence which covers me to drive a 3 wheeler, I have no full car licence at all. I am limited to this or a motor cycle and cannot do shopping on a motor bike and would not feel happy about taking my daughter on the back of one. The nearest shops are a mile away and supermarkets around 1.5 miles.

I have managed to get a friend who is willing to put up an offer of a max of £300 for the car, but as for the rest I don't know what to do. I understand that I cannot make an offer myself for the other Items, it can only be a friend or family member. My family do not know about my BR so cannot ask them or would consider this at all.

I am really feeling down about this as the computer, digital camera, and golf clubs are my only hobbies. I work split shifts at a school and live on site so I don't get away from the job that often so going out in the car at weekends with the camera or golfing on the odd occasion is my only pastime.

I really feel that they are taking my only leisure activities away. I cannot now get my daughter to her friends or grandparents as its too far for her to travel on her own, and if I go with her it limits me to do other things at weekends. Before I could drive her there some 25 miles and be back to do my own thing in an hour. If we travel any other way it means a train and bus and that could take 2 hours and I would have to stay there with her. How unfair can they be.

To sum up if I had known they would do this I would have put some money aside for this eventuality. I listed all these Items because they appeared on my bank statements and credit card, so was worried if I did not declare them I would be thought to have withheld information.

The only good thing so far to come out of this is that a Laptop I listed as my Daughters is safe and she can keep it.

It's my first post on here so be nice to me.
I have had some experience in this field, and I would suggest that your friend offers the OR £300 for all the items. I beleive that the Assistant Official Receiver (AOR), the next one up from the Examiner, would be less than happy if they were to know of this. The cost of collecting and selling these type of items compared to the amount they would obtain at auction for them, make it very uncommercial for them to do so, and can end up even costing them.
Give it a go, and let us know how you got on.

Should I contact the OR to make an offer or does my friend have to do it. Or do I wait till the OR contacts me about them.

I also don't want to offer to little as am afraid they will say no and not let me make another offer.

I did search the internet to see what I would get from a car dealer and on one site put all the details in including no MOT and was offered £125 for it.

Should I speak to someone higher up at the OR to see what can be done??
