Have my OR meeting at 9:30 and although since petitioning for BR I have had some peace of mind the nerves have really kicked in this morning............hope the OR allows for toilet breaks [:D].


I have been told it will last for the usual 30 mins approx so shouldnt be too bad, I will post later with some feed back on how it went

It went well, OR was very pleasant, again non judgemental, was thankful for that.

No IPA ...... although I made notes I cant now decifer them [:I] I am not sure how he came to the final figure?, he disallowed somethings and allowed a bit more for others, but with only £90 surplus income he said that they would not apply an IPA. And to confirm to those who may be in the same boat, or approaching it, he did state that child benefit and working tax credit would not be counted towards income.

Can keep the car, thinks the valuation is ok 2.5K and said even if it was a bit more he didnt think it would be a problem.

Thought i might not get away with £52 pounds for telephone/moby/internet, but didnt question it or ask who my suppliers were.

Another thing that may be of interest, he advised that he will send me a letter regarding the property and the options on the BI, however if I have someone to buy the BI then they will keep in house and only pass to an IP/trustee if I dont have anyone to buy it.

So feel ok, still not sure what will happen with the house, but will wait and see what the OR sets the BI at.

He covered BRO's and although dependant on the outcome of their investigation, he doubted very much this would apply to me, and explained the chances of early discharge in 6-8 months.

One other thing, I was wondering if anyone has had any experience of the following:

I have a computer on a Hire agreement through my employer, its an employee tax incentive paid for through my salary before tax and NI. I have another 18 months of payments to make, with just over 500 pounds outstanding.

The OR was not sure how about this situation and said he would come back to me. Any one know what they could do??

Hi Pippa

Tell the OR that you are obliged to continue making the payments to the computer via your salary, and that if you can't your employers may well find out about the bankruptcy which could threaten your position there.

Also, if you can possibly find a family member to acquire the beneficial interest in the property, I would strongly recommend this rather than see you case passed to an external IP.

He seems to want to move quite quickly with regards the property as he has just called me back! I need to confirm in writing that I have some one who is interested in buying the BI, I need to get this back to him as soon as possible.

As far as the computer is concerned I already advised that the T&A advise that in BR the goods will be taken back, and any tax incentives already saved will have to be paid back. I have just emailed him a copy of the agreement as requested so will wait and see. Daughter will struggle with college course work etc, but in the scheme of things (e.g the house) its the least of my worries.

Does anyone know whether the BI is a true figure of the value of the property or the market value?
