Overtime question

Yes, me again with yet anothe question!

Our IVA is at the stage of waiting for the creditors meeting so I am new to all this and have many questions.

My OH, the only earner, has a basic salary but as he is on call and works overtime these are added in to his salary every month. He never gets paid the same from month to month and it can vary by quite a few hundred pounds or so each month.

The IP asked us for an average monthly figure, which we provided. So, this overtime clause....will this apply for any pay over the monthly average or overtime full stop? My OH basic salary is a good £20K per annum less than what is shown on his P60 at year end...so that is a lot extra on overtime and on call allowances. Does the On Call and Call Out rate count as overtime also?

It will depend upon the type of proposal being used by your IP. Has this not been explained to you fully, if you are at the stage where a creditors meeting has been called?

If the proposal is being submitted on the basis of the IVA protocol, then you will be allowed to earn up to 10% of your basic salary before the 50/50 split applies. All additional monies earned will be taken into account.
