..........

PART 2

My ISP wrote to me and said they had a "responsibility to recoup any PPI monies owed via mis-selling of PPI, in order to reduce the IVA debt to my creditors", and said that a third party would act on my behalf.
I proceeded with this action.

Some PPI monies have already been recouped and paid into my IVA, to reduce my debt to creditors within the IVA.

I did point out to my ISP and the third party, that whilst the solitary loan within my IVA was originally taken out in joint names, (my name first, and my ex wife's second), I had taken on the WHOLE loan debt balance, (via the divorce settlement), and had subsequently taken on the WHOLE loan and credit card debt via my IVA, and it was agreed with my ISP that any PPI monies/reimbursements from the loan and credit card debts, would be put into the IVA, to reduce the IVA/Creditors debt.

It appears that my ex wife has received some PPI correspondence, (which is being forwarded to me), and I believe she basically, "wants her cake and eat it"!!!
By this I mean, that despite exonerating herself from the £80k 'joint' debt, and saddling me and my wife with that debt, she is probably looking for a slice, (probably 50%), of any PPI monies, but is completely ignorant and oblivious that my ISP are "duty bound" to pay any PPI reimbursements back to the creditors within the IVA.

I am surprised the joint creditor has not pursued your ex for the joint debt as they would not be bound by the terms of your divorce. If you wife was joint she will be entitled to some PPI but is also liable for the debt.

When the balance was legally transferred to your sole name, did this also provide for you to be entitled to receive all income and benefits derived from the account, or has the account not been legally transferred at all?
