cchhhd.
The VAT issue is irrelevant as it can be addressed after the IVA has been closed just as will happen in countless closed cases since 2007.
Rob.
Take the point up with your IP about the breach of the IVA and ask for confirmation that they will indemnify you against any loss as a result of the extension.
Jessica.
I would give you the same advice as Rob.

I have noticed on other postings that DFD for example are still closing their files as are we and I would be curious to see what the other firms are doing.

I have already done it! Funnily they havent replied instantly this time, I'm guessing they dont have a standard response for my request.

Furious!

It's not good and I hope you can get this sorted soon.

It's not your fault that this has happened - why should you be penalised?

Well spoke to Tennon again and not much luck she said she will ring me back(we will see) as i want to know what time scale they have to close the IVA complete, which she could not get on the phone, as it is now 70 months in, i asked her if this goes over the agreement time what would happen she said they would contact the creditors and ask for an extension, which i of course said is not an option as i dont want one as it is just dragging it out.

Also she tried to tell me all are in the same boat which i said no as others are still closing them, basically it is tennon company policy atm which is doing this..i a wait the phone call....

Try emailing the IP directly:

http://www.insolvencydirect.bis.gov.uk/fip1/

see if you can get a proper answer.

You've made your payments so cannot see how they can ask for an extension.

Can anyone add advice, i tought the IVA was set by the court and to be paid over a time with a certin amount? would i and the court have to agree anyhting other than what was signed up for by myself and what was diected by the court?

This is just going to put pressure on me and my family if it extended as i need a home next year and planned this timescale around the completion of this IVA. To have it extended gets me worried...

You certainly won't have to make any more payments - you have paid the ones you need to and I really don't see how they can extend.

This is not your fault - you have fulfilled your part of the arrangement, now the IP needs to sort theirs out.

Well that is my understanding, if they have a problem with VAT that is not under my arrangement and if it is it is a company problem not poor old me...

No idea about that - I just put her name in and that's what it came up with so send her an email.
