Payments just before filing BR

Hi,

I am about to file for BR, but have just had to pay my Council tax and Oil supplier as their invoices were due. This has taken me into my overdraft.

Whats done is done, but is this viewed very badly by the OR/IP?

don’t think you would get in trouble for this, as these are essential payments.

Just before I went bankrupt, we had to use our overdraft! We really tried not to but we had to buy a whole new school uniform and shoes and trainers as my youngest daughter has just started high school AND we had to find 2 lots of bankruptcy fees!

I have not heard back yet from the OR so I hope I am not in too much trouble for this!

I am in a similar position - oil and council tax needs to be paid and I can only do that at the end of this month and hearing is on 1 October. Unfortunately, no overdraft facility!!! Well, fortunately actually!!!!!

I feel that this will be overlooked by the Official Receiver, especially if the amount is relatively modest.

I went overdrawn on my BR date!!! I had checked my account the day before my BR date and withdrew all my available money. Unfortunately I thought that a payment had been made when it hadn't, so it went through and I went overdrawn! I had declared on my forms that I had £60 in my account, but when I had the OR interview I had to confess that the account was now £16.32 overdrawn, and all he said was that it would be included in my BR.

Lloyds TSB took £35 for a bank charge out of my account after I went bankrupt. It didn't make me overdrawn but I had declared the money on my forms.

Yesterday is history, tomorrow is a mystery, today is the present - a gift to make the most of.

another point to make is if you are in arrears with bills these can be included in your BR order!

Skippy, Lloyds keep adding charges to my accounts too, even though I've told them I'm BR!!!!

Yes, I paid my council tax a few days after I went BR as they had threatened court action if I didn't. I pay a whopping £205 per month! I paid it because it's an essential bill, I get threatening letters almost every day but I don't pay them unless it's a utility bill.

If you have been sent a Final Notice for Council Tax under Regulation 33 of Council Tax (admin and enforcement) regs 1992 the full years tax is due - therefore this should be included in your IVA/Bankruptcy if you are made bankrupt or undetake an IVA after this date. If you have had a letter threatening Court then the chances are you have had a Final notice!
