I have been in an IVA for the last 2 years, I am 6 months pregnant, my partner and I are saving like mad to be able to pay the IVA during my maternity leave. My IVA supervisor is very unhelpful, and says if I don't send in my payslips I will be in breach and therefore could go bankrupt. This situation is making me physically ill, I will be getting maternity allowance during my maternity leave and therefore won't be able to provide payslips. Is there any other way this can be dealt with?

You need to talk to your IP about a potential variation that will see your commitment drop during your maternity leave. Historically creditors have been pretty open to these proposals as they respect peoples wishes to have children. If you are planning on returning to work after the maternity leave you can make this drop up at the back end of your IVA.

Hi
What is the matter with your Supervisor ?
If you are on maternity and will not get any wage slips then how can you send them in ?
You state that you and your partner are saving like mad so that you can continue to pay the full IVA payments,I presume. This is admirable and you both shold be applauded, not stressed out.
I suggest that you send in copies of your bank statements during maternity to show your wages or ask your employer if they could confirm your wages during your maternity leave and send this onto your IVA provider.

Although you are on maternity leave, you should still get wage slips from your employer showing the sums payable, so the Supervisor is right to ask for them.

You should send in your payslips and then talk to your IP about the continued affordability of this arrangement whilst you are on maternity leave.

Congratulations on your pregnancy sln!

Your I.P should be able to come up with a plan so that you and your partner can still make affordable monthly payments towards your IVA without the stress.

I believe that most creditors are accepting of people in circumstances such as yours, as they cannot expect people to put their plans off for a 5 year period.

Thanks for all of your comments. I have not worked with my employer for enough time to qualify for maternity pay through them, I will be getting maternity allowance through the job centre, so my payslips will simply shown that I am not being paid.

Could I go to my IP and asked if they could suggest a reduction during my maternity leave, which will obviously be made up once I returned to work? If this is refused could it cause problems with my IVA?

It is great to be able to speak to someone about these problems!!

Thanks so much for your help!

That would be a good thing to do, especially if you feel you will struggle to make the payments during your maternity period. I have successfully done this in the past for a number of my own clients, and creditors are generally supportive.

I think this is definately the way forward. Talk to your IP about this and then let us know how you get on.

All the best.
