They all record the phone conversations. For about £10 you can do a subject access request under the data protection act where they will give you copies of all correspondnace including recordings of phone calls that they have had with you.
7 years after starting an IVA I finally received a completion certificate from ClearDebt

Basically:

- Do a letter making stating you are making a subject act request
- You are asking for all copies of information held (both in writing and anything that was recorded)
- State specifically this includes what was transferred from PJG
- Enclose a cheque for £10

They have 40 calendar days as a maximum in which to respond and legally do not have to respond any earlier.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Hufflepuff,

If it was an admin bod that has done this in error then a formal complaint may correct the situation, doing nothing certainly won't.

Write a statement of events, in chronological order.
Enclose copies of communications
Up to latest termination.

Then also download the gateway complaint form here

You can send it electronically, personally I would complete and then select the print to post option at the top (you can always print to a PDF file installing a programme called CUTEpdf on a PC it is very handy)

Then I would draft my complaint to cleardebt using their details found here, simply a copy of what you wrote to the gateway should be enough.

I would send the gateway and the cleardebt complaint recorded delivery.

I would also email the contacts in their complaints link

With a copy of your letter & what you have sent the gateway (printed to PDF earlier or scanned in) send electronic copy stating you have sent the following by recorded to delivery and thought you would let them have an electric copy too to:

You have then done everything in written communication as required.

To just go and setup another IVA on my non professional layperson view would not be a good idea until you have exhausted the above as you're committing to another agreement you would not be able to exit if the above found they had acted incorrectly.

You might want to amend your last post - wrong company. They are with Credit Fix.

Thanks so much everyone for your advice.

I've had an email to day from a 'senior collections manager' asking me to contact him to discuss my I&E. No mention of a termination certificate.

Very confused - it's someone new who I haven't dealt with before and there is no acknowledgement in the email that I contacted CF yesterday.

Any ideas???

Best situation would clearly be to keep your existing IVA going, if it's not too late rather than do a new IVA. Go back to collections and ask if its possible - they will probably then backtrack...!

Spoke to Collection Manager and the termination notice was sent by mistake! Give me strength!!!!
He has confirmed in writing that I can restart my payments at the original amount.

Thanks for all the advice. This forum really is a great place when you are in trouble.

Good News,

I'd say it was the computer OPERATOR that needs the poke in the eye ;)

shame they don't send completion certificates by accident too !!!

I'd still file a complaint over the whole event, it is only when these companies start double checking what they're sending out and are held to task will they be forced to put in some form of audit/ checking process. The sleepless nights you've been caused because some Tw@ couldn't do their job properly !! .... rant rant hurumph rant.....

That is the most frustrating part when you actually manage to talk to someone they seem really helpful
The first line are polite but pretty clueless about most stuff ( esp the difference between their IVA's and the transfers, i just hope i can get throught the next 2.5 years with not much contact ! I have the actual name of my case worker now so can bypass the customer service section ( i think) i do have equity so wont have to argue the calculation but will be fighting tooth and nail for the extra year , i have screen shots of mel's statements of that
