I am desperate,
I have had so many problems with a company called clear start and an IVA its untrue, now they have defaulted the IVA. I asked them to review for temporty the repaymements and they refused, they didnt tell a creditor who sent a baliff and i had to pay him 2 months of IVA money. And to top it all off someone from clearstart called to say that they shouldnt be telling me this but they shouldnt have satrted the IVA as they never asked for or saw any ID of mine. (needless to say they wouldnt leave a name).

I have just been made redundant but am at the final stages of interviews for prision service. I really wanted this IVA to carry on but the cancelled it. if i try pay my debts off i will be doing it for 20 odd years. And if i go bankrupt - my partner will know and leave me and i wont be able to work for the prision service.

Can i set up a new IVA as soon as i am working??

Please help i am desperate here.

I have £240 a month spare at the moment as i am on tax credit and statitory maternity pay.

PLEASE PLEASE HELP ME!!

Hi and welcome

I am not an expert but I can hear your desperation and am feeling for you, I have been there and its not nice.

You seem to be trying with all of this on your own, I know you are afraid to tell your partner but could you reconsider, it just might help you. We all make mistakes and if he/she loves you I am sure they wouldnt want you to suffer alone and in silence.

When the 'baliff' called and you gave them money, were they county court baliffs??? Do you have a ccj against you?? The reason I ask is that a very few creditors send a debt collector round to see if they can get money from you but you really do not have to pay. Only a court baliff can take things from your home.

I was going for an IVA and lost my job and was told that as soon as I was in work I could continue, so I guess the answer is yes, you could try again if bankruptcy is not an option for you.

Please take care and try not to worry, there will be an answer for you.

Take a deep breath.. Im no expert on IVA's .. I am bankrupt and help on here when I can.. the experts will be along later in the day .

Have you spoken to your IP .. not the normal person answering the phone .. some of them seem to be eejits.

I would have thought that with you being made redundant that you have got a damn good reason for asking for a temporary stop in the IVA .

Was the bailiff from clear start or one of the creditors ?

Regarding the Prison job, you would need tro do some research on this but being BR may not exclude you from getting the job, they are desparate for more PO's just now . I am a civvie in the local police, and have am BR .. I checked with them before going BR and they were cool with it ... I have an astromonical level of security clearence.

I also personally know 2 prison officers that have been thru bankruptcy ! I ex wife is a PO and I know a lot of the lads up at the locally prison.

Credit checking for Police and Prison staff is not coming fully in until april next year ! |Some areas dont do any credit checks They are more interested in criminal records !

Keep breathing

I can't comment on another persons case, but I found ClearSTART to be great company. Everything was done by the book.So I can't thank them enough. Other forum experts will come help you....so hang on there.

Appalling support from your IP, throughwhat obviously has been a difficult time for you, and I also suggest that you arrange to speak the IP personally to at least get their view direct from the horse's mouth.

The Prison Service can be quite choosy in their application process, and you will be asked if you are or have been bankrupt, so let's hope you can find a way forward with your existing IP - but if not there is nothing to stop you putting a new one forward - this cannot be done however until your existing one has been formally brought to a conclusion.

Hello Jo,

Welcome to the forum. I am sorry to hear that you have received this level of service from your IVA firm. Would you post a review of your experiences at www.iva.com? This could be very useful to others who are considering an IVA.

Also, if you do wish to appoint a new IVA firm, the existing reviews on our site might be useful.

Good luck and please let us know how things go.

Kind regards,
Terry Balfour

I am so sorry for the problems you have been having I can't help feel there is some communication problem or something I have always found clear start to be excellent - maybe you should always take a name of who you speak to sounds rough but usually then the person speaking to you will so what they are meant to God I am crossing everything for you I don't know what else to say but hope you are ok
