Hi,

My IVA was completed in 2011 and now I have a very good credit rating. 2 things one would I be able to claim ppi as I originally entered the iva in 2006 and it was completed in 2011. DFD were the agents at the time and this was before the PPI claims came out. Second would claiming affect my credit rating etc.. as I've now got my life back on track and don't really need the money but as ppi is coming to an end I'm curious if I was able to claim?

Thanks in advance

Regards

Paul

Hi Paul,

You could claim the PPI -- but you may well be asked for a declaration of no interest from your former IP, which could prove problematic. DFD sold their caseload on and I have no idea as to the status of closed cases in that scenario.
If you use a claims company and the creditor either witholds payment (to offset against the old debt --- some do!) or sends it to Aperture (who took on DFD cases) YOU will be saddled with the bill for their commission.
Claiming should have no effect on your credit rating, unless, of course, you get saddled with a bill for costs which you cannot pay.

I think it's not worth the hassle and to open old wounds as I've put the debt in the past.

I've always been curious about but never followed it through and sounds like it could end up being a pain

I was told by a bit naïve customer service guy at my first IVA company before moving me to Credit fix, that they had managed to get over £11,000 from PPI, I was in shock so, yes, if you have completed your IVA, go for it as this is surely now your money? I only wish that I had claimed it before my IVA :(

I am afraid that it is not your money, Jen. As recently confirmed in the courts, PPI refunds belong to your creditors even after the IVA has been completed.

Agree - it is not your money unless you paid off your total debt plus fees in full.
