Oh and make sure that everything is addressed to the Data Controller, which will be different to the customer services address of the creditor.

Thanks, as mentioned have given 28 days and it has all been done in that way as always, but one of the big things that annoys me in these circumstances, is the cost to me for all this recorded delivery and effort at their mistake/incompetency! ...

I also thought that to add a phone call maybe will give them the opportunity to correct even if not recorded, it may be on a sensible day for them and maybe they actually miraculously just correct things... at least then I can say I tried all avenues to get it corrected... but anyway, for the moment, the letters will be on their desks Monday (tues latest!).

I wouldn't bother phoning them - as inaiva says you need to deal with the Data Controller, not customer services.

hokey-dokey ... thanks ... what a sham ... 6 years... and then some! ... In my working environment, the guests serve their sentence and then time is done... They get released... I have to keep going back each night and locked in with them... The Dungeon Palace inside ... The Dung Place outside... ecky-thump!!

Update: As neither of the two creditors have corrected my credit file, they remain in breach of the Consumer Credit Act 1974 and Data Protection Act 1998 ... I am now preparing a letter and copying documents to forward to the "Information Commissioner" ...

I am still stumped at moving on property until this has been rectified!

Thanks Helen, I hope yours runs smoother ending than mine... This is absolutely disgusting... I have already paid the 6 year penalty of IVA life, and respectfully conducted to fruition... This is now 4 months past the 6 year!

6 years is long enough to be adversly affected by this information on your file. Without creditors making it longer by getting their dates incorrect.

They are indeed in breach of both the Data Protection Act 1998 and the Consumer Credit Act 1974.

Hope it goes well for you and the Information Commissioner rules in your favour and does something swiftly to stop creditors doing this in future.

The Commissioner is obliged to rule to my complaint as it is a clear fact as stipulated. At the time of the IVA meeting, all creditors agreed and I acheived a 100% vote 30/01/2004. By these 2 creditors registering default in 2006 is rediculous and in one case showing I still owe them money today!!! ... I just hope this resolution process is just a matter of days rather than months!!!!!!

Don't hold your breath for a quick fix though - the ICO is apparently snowed under and can take at least 6 months to look at a complaint.

Ohhhh, I hope not Skippy, but then again just shows how badly Creditors are behaving if the complaints are so much... I am really being adversly affected by this matter... What do they want me to do, get in trouble again??? ... The last thing I want to do is approach money sharks at a million percent, just to get a few quid to see me outa here... Experian referred me to their afilliated money advisers, but worked out more expensive than an expensive credit card... I will end up homeless!!!

With all sorts of extra costs £2000 plus recent car bills about £1200, I have not yet reached baseline since closing IVA, so not able to begin to build money behind me yet!
