I guess my take on it is I can understand why IP's and creditors want this money claimed back, if I was a creditor and there was a high probability that the person who owed me money had PPI on other debts they owed then of course if it was going to increase the amount I would be repaid I would expect them to reclaim PPI so it could be redistributed to increase the dividend for all creditors.
LucyLou when you are in an IVA you do not pay an 'agreed monthly payment' you pay as much as you can possibly afford which is reviewed annually to see if your situation has improved and therefore allow you to pay more, and your proposal will clearly state that any assets or windfalls that become due during the life of the IVA will have to be paid in, PPI falls into this category. Why shouldn't your creditors expect you to reclaim it if it is going to increase their dividend
Just to answer the point about loans which may have been paid off prior to the IVA - PPI mis-sold on these may also form an asset within the IVA, so IPs will want to check this out as well.
