At a samaritan meeting last evening I was asked three questions which I can't answer. They arose as a result of my exposition of the forum etc. The forum is advertised in the reception room for in house callers. First, is the forum secure - someone said that a user's private address can be traced by what was called an ISP address on the computer- beyond me that one; second, if a person goes B/R can a debtor change his/her mind and back out; third, once an IVA is agreed (Icalled it registered) can a creditor change their minds and back out of it.

Hi
No one can trace details of anyone posting on here, the site is secure.
A debtor can change their mind anytime upto the bankruptcy hearing but once declared bankrupt it can only be annulled if their whole debts are paid off, or they can sometimes enter into an IVA post bankruptcy.
Once an IVA is agreed a debtor is legally bound and can't back out
Regards

I cannot answer any I.T. questions and that relates to my own job too but the answers to the second and third questions are both no. I can no reason why someone properly advised who petitioned for bankruptcy would want to back out as the only way to do that would be to pay in full plus costs or have an IVA approved. If either of these were options the debtor would not have gone bankrupt. As to an IVA provided the debtor complies the creditors are bound and cannot change their minds whether they accepted the IVA at the time or not.

Beat me to it Andy but at least you could answer the technical question.

Thank you very much - I think now the forum will be used by several people in my locality - because debt advice here is almost non-existent-only the IVA factories in yellow pages.

The more people who know about it the less people will fall into the arms of the vultures who promise the earth and never deliver!!!
Discharged today the 8th feb 2012. View is much brighter now.

Vultures! That is putting it mildly - I had one sometime ago - before IVA - for £3,000 I would have all my debts cancelled and a clean record!! They claimed an enormous success rate but offered no proof.

"No one can trace details of anyone posting on here, the site is secure."

Not wanted to cause panic here, but this statement isn't quite true .. any site can be hacked given the right equipment and enough time, but there are not many who can do it and the ones who do are more likely to be looking a bank web pages etc. So I'd say on a scale of one to 10 this forum is probably 9.5 safe.
Trying Again

There's never been a problem while I've been posting on here.

One thing I would say is don't put your full name in your profile. I did and my IP read my blog and knew who I was.

I had mine in to start off with, but took it out when I realised that people would know who I was.

Thank you for all your comments - be fine now - the forum will now be recommended by the samaritans branch here. Melanie - how right you are - I hope Trading Standards can shut them down. Trouble is these people are shut down in one name and start up again in another!
