questions from completed a full and final IVA

Hi there, my husband successfully completed a full and final IVA September 2007, I have some questions I would like answered please, Can we reclaim bank charges from our previous bank? and How long before we can get credit again?

Congrats for completing your IVA.....there is nothing to stop you trying for credit, (although personally i wouldnt ever want credit again). But you may not be succesful as the IVA does stay on your credit file for 6 years.

I aint to sure about the bank charges thing.

Thanks for your advice I don't want to be complacent about the fact we had so much debt, we are managing very well without credit and it is a wonderful feeling to think the only debt we have is our mortgage, but maybe soon we are thinking of remortgaging and was concerned what obstacles we would face.

there are mortgages for you...best advise i can give is to make sure a copy of your IVA cert to the credit agencies (equifax and experion) and then send for a copy of those files to make sure everything shows as satisfied and that the IVA shows complete. There are some fab mortgage brokers such as Leybridge who can search the whole market for you.

Hi dev92,

If you speak to a mortgage broker used to dealing with IVA and post-IVA cases you'll find that there are lots of lenders who are interested in this market. Typically they're not the high street names but lenders that sell mortgages via mortgage brokers. As bagpuss mentions any of the brokers on this site would be delighted to help you.

In terms of any mortgage obstacles that you might face it will depend entirely on your personal circumstances. Any broker will spend as much time as is necessary to learn about those circumstances in an effort to match you with the best possible mortgage/lender.

You can claim bank charges from your bank but the claim will immediately be 'suspended'. The reason for this is that the Office of Fair Trading is taking a number of the major banks to court to decide whether the charges were ever lawful or not. Until that court case is concluded it's unlikely that any bank will pay out. The court case starts early in 2008 and there could be appeals afterwards.

about your bank charges it wont cost you to try and get them so why not try and see

I have recently re-mortgaged with "preferred" whilst in an IVA ... huge interset rate and I know they have tightened up because of the current USA situation, but it has helped to get me out of a tricky sitaution ... but Mike will be able to give you more info.
