I'm wondering what will happen as we've just been awarded the lower care and lower mobility for our son and I think there will also be a small back payment as it took a while to get sorted out.
I know from what I've read on here that we have to do a new I&E, but surely this money should be paid either to my son for the care he requires etc.
Also, will we be able to keep the backpayment if there is one, which will be used for his benefit, as it isnt an unexpected windfall, it was always going to come to us for his care in the event of us getting the medical proof to the DLA.
The DLA should be ok as it will be offset against your sons needs.
You need to speak to your IP regarding the back pay. Hopefully you will be able to keep it.

Hi and welcome from me too, I agree with Jan, speak to your IP and ensure that when you do your revised I&E you can clearly demonstrate where this extra money is needed for your sons care needs and I am sure they will accommodate this
Thanks, I hoped this might be the case, but have to admit its tempting to just get it paid into my sons savings account and use it for him from there.
I know this isnt really pc, and dont mean to offend anyone, its just that we've fought hard enough to get the award from the DWP and now we need to sort out how this affetcs the IVA. I bet the DWP would have something to say about it, if they knew some of the benefit they are paying out has the potential to be gulped up in these agreements, escpecially when the person (my son) awarded it doesnt have an IVA.
Personally I would be totally honest and upfront with you IP. Lower rate care and mob components are not great amounts of money and I am sure you can demonstrate what this will fund.
For example taxis and additional petrol for the mob and additional clothing or equipment for the care component. Have a think and write a list of what you spend over and above for a son without health issues as this will help your case to keep the income.
Tell your IP you have scrimped from other allowances up until now and would like to use the arrears to put away in case you need to buy anything in the future for your son.
I hope you do get to keep some of this back pay - you will already have paid out towards your sons upkeep.
