hi have now recieved a statuory demand from one of my creditors do you think i will get this demand set aside as going through a iva process or will my ip be able to do it for me

A successful IVA will over ride any demands/CCjs etc.Pass it onto your IP and seek their advice as to what to do,if anything

i knowbut its wheather my proposal and creditors meeting is done before the 21 days are up as when is it that the ip contacts the court in saying that we are proceding with a iva and that then no further court procedings can be issued

A statutory demand is simply a pre-cursor to bankruptcy proceedings, so I would not worry about it unduly, but your IP does need to know about it and it would be courteous to the solicitors acting for the creditor concerned if they wrote to them explaining the situation. Your IP does need to get motoring with finalising the IVA proposal - how long do you think this is likely to take?

ive spoke to the company im dealing with and they said everything is now being checked and then my proposal will be sent out but to send them the demand and will ring the creditors explaining where there up to the debt is only 2400 for this creditor so do you think they would make me bankrupt because it will cost them quite a bit or do you think i should offer them installments for now until iva is done as this would keep them quiet for a bit or is this naughty of me

I would not worry about this demand, but send it on to your IP and let them deal with it.

ive got until the 27 of this month how long afterwards does it take to make somebody bankrupt

There is no definitive time - but I would say 6 weeks or so depending upon the speed of the solicitors and the timing of the Court list.

No - unless your IP is seeking an Interim Order of the Court, you only get the benefit of the cessation of legal action once your creditors have actually accepted your IVA proposals at a creditors meeting. Is your IP going to seek an Interim Order?

it says on my letter that once the proposal is signed by me the proposal will then be lodged with your local court who will issue a case number then the proposal is forwarded to my creditors for consideration

The Court is merely a mailbox in today's world, and in reality most IPs do not wait for the Court case number before issuing the proposals to creditors and calling the creditors meeting. Which IP firm are you using?
