Good evening all.
I am still waiting for my proposal to be put through to my creditors and up to a couple of weeks ago I've only received reminder letters. Recently I've bben receiving phone calls all day and into the evening,(one call at 9pm). I beeen honest and open with my creditors, telling them my situation and that my IP is dealing with the proposal and they will be contacted in due course. Last week, Goldfish called, I tld them I had already spoken to someone form their company and I couldn't stay on the phone as my daughter was in the kitchen and there was a wok full of oil unattended!!..she didn't believe me and insisted I make payment!!..I got really upset and put the phone down on her. Today I've received another call from another creditor requesting an update. I told him what the current status of my IVA was and he went on to tell me that the creditors can take futher action such as an Attachment of Earnings if I do not pay. He said some debtors lie to save themselves from paying up. I told him I do not lie and I've kept them informed. I then gave him the contact details of the IP. I am really worried now as it seems that some of the crditors are taking matters in to their own hands and threatening all sorts. Help please???

You have taken all the right steps,and it is only a matter of time before your IVA gets sorted. I honestly wouldnt worry too much about the calls, Talk is cheap and the people in the call centres are told to do all they can to get money out of you...just give your IPs name and number and tell them you really cant help them anymore as the matter is out of your hands!

As jpj says some of the staff at the call centres will say anything. I had a very aggressive creditor thaphoned fourteen times one day, doing things like putting the phone down in mid conversation and telling us that we would be charged £10 for every call. Ignore them be polite and refer them to your Ip firm. It is so hard when you are getting these calls, hopefully not for much longer though. Is your meeting in the near future.

From our experiences, Goldfish are the worst and will spout any rubbish to scare you

They told us

An Iva takes a minimum of six months to set up
They would turn my IVA down because i've used the card in the last 6 months

In the end, despite ringing every day, they were the only creditor of 13 not to vote

A little bird tells me that your IVA will be finalised and sent out tomorrow. So this should stop the nasty and unecessary telephone calls, as your creditors are perfectly aware of your situation.

Hi not sure if this is good advice but certainly worked for me. Im just waiting the outcome of the creditors meeting, so towarsds the end of the jouney. I wrote to all my creditors telling them that i was seeking help and was going to look towards an IVA i then changed my telephone number. NO CALLS FROM CREDITORS!!!!!! Usual letters but saved the constant calls

Thank you all so much for replying. I really do appreciate your advice. Apart from trying to fend off another cold I am feeling a lot better knowing I am not alone.

Hi, Hang on in there. My creditors rang me all the time trying to get money off me. My case officer said I could give them her number and she would deal with them. I now have my IVA approved and still Mercers keep ringing, I have told them 4 times now of my situation, the last person asked for an emergency paymet of 45.00, I refused saying that even if I had the money I could not pay as it would be prefering a creditor and that would breach the terms of my agreement, she went quiet and that was that but the calls still keep comin.
I monitor my calls now to avoid them. They gotta stop one day.

Sorry if I am flippant here but next time you are cooking and you get a call tell them that unless you go and attend to your cooking there won't be any assets because of a fire to even pay your account!!!!

a while before my IVA started i used to get one creditor who used to ring me every evening on the hour. got so fed up with them that I had a thrash metal CD set up and when they rang put it on at full blast and then put the phone on next to the speaker! made me feel better and there phone calls did decrease after that!

have to say that when my IVA was approved the phone calls did stop practically overnight!

Hi Spreadlove,
The harassment you are receiving is part and parcel of the IVA process and can vary from very little contact to constant calls throughout the day including calls to your place of work if they have the number. This can last right up to the IVA being put in place and in some cases a little while after.. It does take a while for the systems to be updated. The creditors are just following the procedures to recover their money. Please be patient and calm as the clouds are slowly lifting and all will be ok..

The calls have been relentless, especially from Mbna who called me twice within 5 minutes of each other last night. I am not hiding from my debts, I am facing them head on and up to now I have taken the time to talk to them. The call from Goldfish was the last straw. Thank you once again for your messages and advice, I always feel a lot better after reading your posts.

Try not to take it personaly as I think it seems to be a computer generated system that seems to call at random and you will get lots of calls.
I updated all my creditors everytime they called and most put 'a hold' on my account for a week at a time to stop all the calls in the meantime.
I had lots of creditors - barclaycard, morgan stanley, citi, amex, mbna, rbs, mint, capital one , john lewis,intelligent finance, hsbc (still makes me feel ashamed...)
The best way is to be frank and honest and explain why you are in the situation you are in and explain you are taking advice on your situation and can they put a hold on the account for a week.
I tried not to take it personaly as they are only doing there jobs, but when they were thretening I would just say my mobile signal was going, I can't hear you..., hello, and then cut them off. Luckily they did not have my home number as I updated them all with my work fax line when I knew I was in trouble, I think it would have driven me mad to get calls on home line as well as mobile.
Be prepared for calls between 8am and 9pm (although I did have one at 7.45am on a Saturday morning!!)

just explain to them your situation and how stressful it all is, most of the creditors were sympathetic except for HFC bank, they hounded us with calls every 5 mins, then when we did answer they were abusive, frightening even to the point where the regional manager threatened us with bankruptcy, he stated that in the creditors meeting he would poison the minds of the other creditors to make us go bankrupt and we would loose everything, how we got by those final few months i don't know but you find strength from somewhere to get you through, my belief was we were so much in debt 46k that there had to be a light at the end of the tunnel, i also believe that things in life happen for a reason, and had we not made that phonecall then we would most definately lost everything, we successfully completed our IVA in Sept 07, and now there is no going back!!
