A standard week is about 70... I am looking at a new job in a prison right now that is half the hours but similar pay, so hope not to have to ask for re-calc on IVA

Payment for time off

Employees should be paid the appropriate hourly rate for the period of absence from work but an employer does not have to pay more than two-fifths of a week's pay, regardless of the length of time off allowed. This is arrived at by dividing the amount of a week's pay by the number of normal working hours in the week. The method of calculation is similar to that used for computing redundancy payments. The week's pay is calculated by reference to a date known as 'the calculation date'. In computing pay for time off to look for work or arrange training, this date is the one on which notice was given by the employer.

An employer does not have to pay more than once for the same period. Any payment already made under an employee's contract of employment for a period of time off to look for work will be offset against the employer's liability under the provisions. If payment has been made by an employer for time off to look for work under the provisions, this will reduce any liability under the contract of employment.

What if my employer cannot pay?

If your employer is insolvent, we will pay you and claim back the payment from the assets of the business. Ask your employer's representative (for example: liquidator, receiver or trustee) for a claim form "RP1". Fill it in as soon as possible after your employment has ended and send it to the Redundancy Payments Office.

Tax

You will not pay income tax on a statutory redundancy payment though other redundancy payments you receive from your employer may be taxable - see Inland Revenue leaflet Redundancy factsheet. Normally your employer may set the payments against tax as business expense (for further details, see the Inspectors manual - or after mid-2003 the Business income manual - in the Publications section of the HM Revenue and Customs (formerly Inland Revenue) website.

Time off for job hunting or to arrange training when facing redundancy

An employee who is given notice of dismissal because of redundancy is entitled to reasonable time off with pay during working hours to look for another job or make arrangements for training for future employment. The time off must be allowed during the period of notice.

Employees are entitled to time off in this way only if they have had two years' continuous employment with their employer on the date their notice expires or the date when the statutory minimum period of notice due under the legislation expires, whichever is the later.

Additional Notes:

Although I had been expecting something to happen for many months past, I will admit that it was a total shock actually receiving the first email from my Contract's Manager, that after so many years, it now became reality.

I have taken on board notes here from wonderful forum members that I am handling all this different to them, but I will admit here and now; from the time of revelation, it took well into the next day for my hands to stop trembling, so I am not some super human... Somehow the shock of it all I think lessened the blow of the bank fraud at the same time, so just got on with trying to deal with it best I could, but within moments of my hands having stopped trembling, they began again because of the bank issues... then dealing with being head up for interview for new job.

With so much going on right now, it is a big blow to the system, but everything is happening all at once, so maybe better than returns of the eebeee-geeebees.

I have taken great strength from the words of support here and so has made a great deal of difference to how I have handled it too, so, if you too feel that you are alone in your issues, be sure that solid and empathetic (not looking sympathetic) views will be taken from this forum... It does make a difference!

In my outreach website, I promote support for welfare and distress and I look forward when I have good time and frame in mind to begin creating a page dedicated to this forum instead of the couple of loose text links I have at the moment. I feel that this forum is an asset to many aspects of support, and not just IVA, BR or the like, but also for health matters, as the understandings of all on here are the cure and can even be the medicine... So, doctor, doctor, prescribe me a winning lottery ticket... pretty please! (tee-hee)

No, really, thanks to all you bods out there, you mean so much to my healing of all this and never realised before joining all those weeks ago, that you could make such a difference.

I have also been surfing some more of these posts, and noticed some of the F&F agreements that I was surprised went through at such low pIN£, so I am now going to re-count my pot (providing all works out) and maybe... just maybe... just may be... I could offer a F&F as long as they accept that I need money to see through working in hand for new job, so not to eat all my redundancy (if I get it!)... Then of course will be to hope that the IP will agree to a payment plan for the fees outside and after the IVA settlement... I am now looking at maybe I could knock out two aspects in one go, but it will mean maybe looking at around 20pIN£

For the purposes of those facing redundancy and to maybe compare IVAs, I write below a paragraph from my IVA regs:

"If my voluntary contributions fall into arrears by two months, not necessarily consecutively, and a third is due, or should they fall below a specified level, the Arrangement shall be deemed to be failed. The Supervisor shall immediately arrange a meeting of creditors for the purpose of deciding whether or not a petition for the debtor's bankruptcy should be made. If however, my payments fall into arrears because of redundancy, and I do not receive any lump sum redundancy pay, I shall be allowed a period of six months without making any contributions, in order to find further employment, such period of non-payment to be added to the duration of the proposal. If I should receive a lump sum in respect of redundancy pay, I shall be permitted to retain the equivalent of six month net salary from which my voluntary contributions shall be maintained and the balance shall be offered to the Supervisor for the benefit of the creditors. If, I have still not obtained employment after six months. the arrangement will then be in default and the Supervisor shall seek the views of the creditors as to further action."

As you are towards the end of the IVA,and are not a homeowner with the equity release clause,you may be pleasantly surprised as to how your creditors will view a full and final,even if it is a smaller dividend than proposed.

Thanks Andy, but after fullest calculations, it works out that after this current month, I will not receive full income until end of December, so a majority of all monies received this month, vacation pay due and redundancy has to be spread through to end of December (3 full months) and that in itself will almost clear me out again (allowing also for the arrears settle-up). AND of course will all depend on my receiving redundancy... if I do not get any, there will be a enormous shortfall for 3 months.

If at the end of December I have residue to consider, it is then it will be the right time to look at what I might have to offer.

Including arrears and providing I maintain my contributions of November & December and January, my balance will be: £11,600 (24x£450 + £800arr)

My annual returns date will be Jan 30 2008

My full 72 month term will be Jan 30 2010

What percentage is fair? ... I do not want to waste time and effort by offering some silly amount like £1,000 if lucky to have that by then! ... Then of course will be the IP fees and payment term to get agreed.

Having received my redundancy cheque immediately the day after laid off (ended 31/10) and their correct value but wrong name... I have been faced with touch and go that the cheque will be processed. I had to send a cover letter with the cheque to support and prove it was for me! I am also to receive a PILN cheque in 2 weeks and hope they get that name right.

Over all it will be a reasonable compensation value, but not enough for F&F with everything else that is being expensed at the moment. I am fortunate in just one other way that my long application process for the Prison job comes to fruition in a few days time... So... still another 2 years of IVA to go (almost 4 done)...
