It is really important to find out why your IVA has been rejected, so that if you decide to represent it at some stage in the future you can address thoses issues.

no there wasn`t a specific reason
i do know that my ip as in talks with nr yesterday
maybe to up the payment or make it go on longer
i don`t really understand it all fully yet

Hi, I'm new to here but had to reply to this post. I have just had my IVA rejected, again by Northern Rock. They were my main creditor with £16915 debt and they said 'no' with 44% deciding vote. They have rejected it twice now, coming out with some surreal reasons. The IVA proposal was done by Blair Endersby (Baines & Ernst) and finally the insolvency practitioner tried to make them see sense but they wouldn't listen. They are saying I'm not in enough debt (£16915 to them, and £38k altogther, plus around £18 negative equity on house), which Blair endersby say is strange. It just sounds to me that they are just making excuses because they are struggling themselves. Blair endersby pointed out to them that if I go BR they'll get nothing but they didn't care, they want me to enter a debt management plan. So sorry to give you bad info Meash, just wanted you to know what I'm going through with them. As for myself, I really don't know what to do now, am seriously considering BR, although I would like to stay in my home, due to being recently married. My poor wife has not benefited one bit for my debt as it was mostly gained during my last relationship. Can anyone give me some much needed advice?

Here was the voting at the last (and final meeting) :

HSBC Credit Card £1575 - 4% vote - yes
HSBC Overdraft £2090 - 5% vote - yes
Mint Mastercard £6933 - 18% vote - yes
Goldfish Card £5818 - 15% vote - yes
nationwide Card £4288 - 11% vote - yes
Halifax Card £1003 - 3% vote - yes

Northern rock £16915 - 44% vote - NO

Hey grantspants, welcome to the forum. Your post is very informative, that's what this forum is all about. Please hang in there and one of the technical experts will be along to offer advice. I really don't understand the reason NR gave, it's crazy.

Hi Grantspants,I am sorry to hear that, for you and for me. It doesn't bode well. I haven't heard the reasons yet but being in not enough debt won't apply to me!!! I owe around 90K with NR being the biggest creditor at 55K....when I write it down it still freaks me out. I am looking at BR but am too newly married with young kids and they have certainly not benefited from the debt one bit. I do have a small amount of equity in the house but if I go BR then it will be a tiny proportion of what is owed. I have had some advise from the BR forum in that I will have to act quick to make a BR application as NR could secure some of the unsecured lending. However I am still waiting on my IP turning this around, so can't move too quickly. I'm in bits!!

I'm sorry to hear that Meash, its very frustrating isn't it? I am worried about it but trying not to show it too much. As long as my wife is ok and we're both healthy then thats all that matters to me. She has been very good about all my problems, I couldn't ask for more.
I took it upon myself to call Northern Rock personally today and actually spoke to the lady who dealt with my case. She said that they use their own system to decide cases, and the main points of my case were, the term of my debt and my CII score. My loan with them used to be an unsecured loan linked to a mortgage but when I moved my mortgage away from them it just became a normal unsecured loan, albeit with a 25 year term (20 left) and now 12.9% apr or something like that. My CII score was 28, which means nothing to me to be honest, but she says its based on current financial commitments. In other words, I'm not overstretched. Which is rubbish really as my outgoings now outnumber my incomings. I pointed out that my proposal obviously included my income and expenditure and clearly showed I was in trouble. But she also stated that my IP didn't come back with any changes or offered anything else, which they dispute as they say they offered 72 month terms, so who knows. Basically now, I have asked Blair endersby to re-propose my IVA and add another £100 to the payments (now £324) which was an allowance set aside for my wife. They allowed me this due to the fact that she wasn't with me during the time my debt was accrued. She has been good enough to do that, although I still feel bad for her as her wages have been taken into account and she only works part-time. Hopefully they will realise that I am doing all I can to pay them back and accept the latest proposal. If that fails then it doesn't look good, but at least I can say I've tried everything to get the IVA approved.

My partner has been so supportive too. I will wait to hear from my IP again but may well follow suit and speak to NR myself. I guess they will think the same of me, as £700 of my and hubby's wages goes straight to child care, which we can do nothing about, unless I give up work. Our payments of £527 would increase significantly in 3 years time, when the kids are in school but they are obviously not looking long term. Who knows where this will end. Good luck in sorting yours out too.

grantspants, that's amazing that you actually got to speak to the decision maker at NR. Now we know a little bit more about how NR decide.

Hi Meesh, i hope that next week goes better for you seems that NR are being a little harsh and causing you all of this worry. Be postive and try not to worry i shall send you some reiki and hope that things turn round for you.

Just a quick note for you all who are worried about bankruptcy.
My husband and I had our IVA agreed in feb 2007 but due to my ill health and long term sickness we struggled with payments. After many many months deliberating about bankruptcy we bit the bullet and are about to hand in our forms. We moved out of our house in June, into a rented house, and its the best thing i have ever done. The huge relief we feel is immense. None of our creditors know this address or telephone number, and i really believe it was the best decision we made. And we too have a young child. If that is the only route that you can take, do not be ashamed or frightened. It will work out for the best xxx
IVA in 2007 - failed in 2008.

That is exactly what we did, it is the best thing we could have done, got Early Discharge after 6 months, no IPA and now we are over it and getting on with our lives, no debt! its great
