Hi there,

I recently got involved in a relationship with a compulsive liar, when i left him he has said i owe him money for various things he paid for, never saying i would have to pay him so i have refused to pay. I am on an IVA and he has my details from the Insolvency Register. He said he has called my IVA practitioner and they have said that that can arrange to have money taken from my salary though my HR Dept. Is this true? I wouldnt have thought so because then people could just lie about amounts of money owed and have them taken from other people salaries?

Good news! Firstly your IP would never discuss such sensitive information with him or anyone else without your permision. secoundly he has to prove in a court that you owe him money and I think this would come under a different type of debt and not like a creditor as we know on here. call his bluff also your HR dept would not discuss such a personal thing with anyone. he sounds a nasty character but the laws on your side you can take steps along the harrassment route. wait for the experts on here to come along but dont worry all what he has threatend can not happen Howard

Hi and welcome.

Don't worry, your IP would not discuss anything to do with your case with anyone other than you. They cannot arrange to have money taken out of your salary at all.

He is trying to bully you into paying him. If you don't owe him anything, then just ignore him.

Hi there & welcome to the forum.
I am sorry to here about your relationship & the troubles you are having.
My first thought that he is probably lying about speaking to your IVA practitioner as this would breach the private & confidential policy that your IP will have. I believe that only you yourself can speak about your IVA with your IVA practitioner & team. And taking money from your salary through your HR dept is highly unlikely too. As you said he is a compulsive liar - sounds like he is just trying to scare you into giving him money. Hope my view on this helps you. Keep on posting if you have any other concerns - this forum is a great support during a IVA.

I agree with the others - your IP wouldn't have spoken to him without your permission and I'm sure your HR department wouldn't have done so either.

As far as I'm aware to have the money deducted from your salary as an attachment of earnings he would need to prove in a court of law that you owed the money. It would be down to him to prove this, as in the civil courts the burden of proof is on the person bringing the case.

He would have to have a CCJ for attachment of earnings wouldn't he? It would cost him a fortune to take you to court, especially if he has no proof of this money.

No deductions can be taken without a legal order, i.e. attachment of earnings from the court.

He sounds like a bully as well as a liar, rise above it and ignore him. Like the others have said you've done well to get rid of him, you deserve so much better.

What a bounder! Don't worry about this, he would firstly have to prove his claim - which would be very difficult in the absence of any legal agreement between you. And there is no way your IP would have spoken to him without your permission first.

I may well have used a stronger word than bounder, but as others have said you sound well shot.

I personally would call his bluff and say that you are happy to have a salary deduction, and then give him your wages department telephone number to arrange it.

The backtracking you will see may be very amusing.....

I know that we tend to get one side of an argument, but I do have to say here that I cannot abide bullies. A metorphorical kick in the you know wheres seems well in order.

he he he, i've taken the viper venom, Lisinopril, absolutely chilled out now, i shall be in bed by 9 again, honestly the drug is derived from the venom of a Brazilian pit viper.
