Hi all I posted the other day about asking for a 3 month break in order to pay an £800 solicitors bill, well finally got to speak to someone today and it was a flat out no as my IVA will fail. She said I should save it well I bring home between £600-£800 a month and pay out £342 to my iva. I pay £160 rent , £70 car + £30 insurance leaving me with just £198 at the most for petrol , toiletries , food , car maintenance , precriptions etc.AGAIN I ASK WHERE DO I GET £800 OUT OF THAT!!! I then asked about rescheduling payments to extend for 12 months but would be a better return for my creditors and the payments would be easier for me to manage, again I was fobbed off with a "I'll get back to you" The paperwork regarding all this has been on her desk for a fortnight now ! Sorry for moaning I just dont know where to turn next.

Hi Becky

Perhaps the IVA could be varied ie reduce the payments for 6 months.

As for the solicitor's fee you could ask them if you could pay it over 6 months by standing order. after all everyone wants to get their money.

Have asked her for advice and have basically been told it was set up that way and thats the way it stays.Im so sick of being fobbed off all the time I've never been able to speak to my IP as he doesnt take calls apparently , so I have to deal with an assistant

sorry me AGAIN!! This is all just too hard can I get back on a dmp and out of an iva . I realise i got myself in debt but settin unrealistic payments benefits neither the debtor or the creditor when the iva fails.

It is not acceptable that your IP will not speak to you - he is being paid to supervise your arrangement and you are therefore important to him. Your IVA can be varied to give a more affordable payment, so I therefore suggest you send written details to your IP via his direct e-mail, put a read receipt on it to ensure that he has the details, and tell him that you will be calling him over the next couple of days and that you expect him to answer your call.

Hi Melanie thanks for the reply I am dealing with a supervisor at the moment who has everything in writing but cant talk to him because she doesn't know when he'll be there. She wont give me an email address or direct phoneline as she said she is in charge of my file but isnt authorised to make decisions??

Hardly in charge then is she! And why will they not give you a direct line of contact with the person supervising your arrangement if you need to speak to him?

No idea she just said she was the one dealing with my file. Ive sent a copy of the letter i sent her last week again today but addressed to my ip , though if he isnt there dont know what good it will do

It,s this sort of "service" that gives the industry a bad name.
Ask for a face to face meeting with your IP and get this sorted.Just how can they expect you to save £800 when all disposible income is meant to be paid into the IVA ?
Ask for a three month payment break and the shortfall to be added onto the end of your IVA.

well rang them again this morning and he's there but not taking calls so she said she would be able to see him after 11 and she'd call me back. I told her not to bother i'll ring her because she never gets back to me. hopefully i'll get this sorted today. Im now trying to reschedule payments to a more affordable amount as she said i definately would not be allowed a 3 month break as this would cause my iva to fail!!

finally heard back from accuma , i now have to send in proof of my earnings but it is still unlikely i will get a variation as apparently all creditors are taking a firm stance on these. I asked about changing back to a dmp and she said its my decision but creditors will start chasing me again. I wish i'd just stayed as I was this is all so stressful!!

Your IP can authorise a three month break without consulting your creditors and simply tag it on the end.
Do you think hat you can afford your original payments after a three month break ? If so I would press your IP to allow a payment break so that you can pay your solicitor fees.

Hi Andy i asked about a repayment break first and I was told it was not an option and my iva will fail. I dont think I will be able to keep the repayments up even after a 3 month break at the current amount anyway as all the money from that will be used to pay the solicitors bill

Thats fine,you will need a variation meeting to lower the payments.
Good luck and you deserve to get to the end of your IVA.
I am surprised that they can,t authorise a three month payment break,I wonder what Melanies view on this is ?

I need to send in copies of my accounts to prove my income dont see how they will help as they show I take home less than is set out in my I and E. She didnt sound very hopeful on the phone said she'd shown my ip the proposal and he didnt think my creditors would accept it. originally i was to pay in £22620 and my new proposal has me paying in £21626.25 over 6 years rather than 5 and realising a dividend of 27p in £
