I am trying to get my IVA completed and my paperwork returned to me. I telephoned my IVA case manager shortly after I was made BR and nothing happened and I sent a letter 2 weeks ago with a copy of my BR order and I haven't received a reply. I am going to send another letter by Recorded Delivery - should I send this for the attention of my IP or my case manager?

Yesterday is history, tomorrow is a mystery, today is the present - a gift to make the most of.

Skip, if it were me I would send a recorded delivery letter and put a time limit of say 14 days and I would address it to the IP, he/she can pass it down if needs be.

Hi Skippy

Whilst this is frustrating for you, it is not really prejudicing your position. So long as the IVA is closed before you get your discharge from bankruptcy, then the timing will not affect you. In reality, your IP is probably still dealing with queries raised by the OR.

The reason I want everything sorted out is that we are going to be moving this year, and I want to make sure that nothing gets sent to the wrong address. If they are answering questions from the OR fair enough, but a response to my letter would be nice, especially as I keep getting letters from them telling me that they couldn't pull my DD!

A question for Melanie - what will happen if they haven't completed my IVA by the time I'm discharged from BR?

Hi Skippy,

I had a letter from my IVA company last week stating the the variation meeting proposal was rejected and that as i have already petitioned my own BR then the case is closed however i have already paid almost 4K and guess what my total fees was me owing them £5 which they said they would waiver. Anyway my name has now been removed from the insolvency website for my IVA. I have not had any off my paper work returned as they said they do not have them i am only bother about my HP agreement for the car they told me they photo copy the originals then they returned them back to me last year which is totally in accurate. Well almost there now move out my house in 6 weeks time going to B & B by the local council until they can home me properly, how do i cook for 2 kids in B & B and wash cloths but at least it is better than nothing even thought about pitching my tent in the local camp site.

(I apologise for my keyboards poor spelling and grammar)

I got home tonight to find another letter from Accuma informing me that they have tried to take my direct debit but it's failed. Oh well, a recorded letter will be going off tomorrow.

My paperwork finally arrived this morning! However, there are a couple of things that were in there that I'm not sure about:

1. There is a extract from the land register relating to my address. However, the flat is in my partner's name, so was the search to confirm that I don't actually part own the property? I was never told that there would be a land registry search.

2. There is a printout of a payslip calculator which has partner's income and expenditure written at the top. There is a figure in the gross pay box which bears no relation to any figures relating to Dave's income, and in the tax code box they have my tax code! When my contributions were assessed some of Dave's income was included and supposedly offset against mine and I am presuming this is how they arrived at the figure!

3. My final point! I had to provide a list of Dave's outgoings, and some of them have been crossed through, which is fair enough as they were things like Sky and broadband, but they have also not included the property maintenance charge. We HAVE to pay that to live here as it does what it says on the tin and pays for the maintenance of the flats! Surely if there was a problem with this I should have been asked about it?

I know all this is in the past now, and these questions are mainly to satisfy my curiosity as one of the reasons that I couldn't afford my IVA was because they took Dave's income into account didn't offset it against mine - the proposal said I was paying the mortgage of £556 and they included £560 of Dave's salary to cover it, but it failed to take into account the fact that I pay £200 'rent' and not the full amount. This meant that I was £200 short each month. I know I should have picked this up at the time, but I was so caught up in making sure my IVA was accepted that I didn't.

So everyone contemplating an IVA - make sure you read everything 10 times over, and if you don't agree with something, don't sign the proposal until you are satisfied that it is correct.

Skippy 13, very good advice!Many a time people in financial difficulties are desperate to resolve them and will simply sign the IVA proposal without reading it carefully.

coco, it will be difficult in a B & B, but the council will find you appropriate housing and you and your family can resume life as normal. Children are resilient and will view it as an adventure. At least you are all together and your love will see you through.
