3; Have you spoken to other companies/experts to see if an IVA is actually an option now ? It could be that your equity/disposable income is such that an IVA may now be an option ? Hi Andy, Thanks for your reply. Can an IVA be done now with a remaining debt of £18.5k? My DMP is due to clear by July...

Thanks for taking the time to reply, I accept the opinions given on here. However, I would also appreciate your comments on the other points that i've raised: 1) The option of an IVA was never mentioned to me by the CCCS. surely they, in an expert advisory capacity, should have presented me with ALL...

Aren't you paying £420 int your DMP on a monthly basis? This is called disposable income. So over a 5 year period you would have paid £25,200 to your creditors if you had maintained regular monthly payments at that level. Agreed, but people with IVA's also have 'disposable income' that they pay int...

But you had disposable income you could also pay on an ongoing basis! Please clarify what you mean by this Melanie.....I get the feeling that you think I had additional money over and above the payments i was already unable to keep towards my creditors... My so called 'disposable income' was and is...

I agree Johnny. Although we had a fair amount of equity in the house, it wasn't more than our debts so we were able to get an IVA. I've read on here before that if equity is more than your debts, then an IVA is not usually a solution. My debts were £55,000 and my 'potential' equity BEFORE estate ag...

Having just skimmed through the above you don't appear to be asset insolvent and so an IVA is unlikely to have been appropriate. In my anecdotal experience CCCS have a policy to try to avoid securing debt on property and your IVA would have involved a hefty sub prime remortgage if it was even possi...

Hi, all I'm looking for to be honest is for an expert opinion on whether the reasons that CCCS have given for not discussing let alone offering the option of an IVA to me, are valid. I will be posting their reasons later this evening including the summarised details of my case. Basically, if the exp...

... it is not for posters to get specific advice about an area where we have no background knowledge of your case. The basis of my complaint has already been stated earlier in this thread and a number of people have already advised that they feel it was not right that an IVA wasn't even mentioned t...

Can I just say that I do not think it is appropriate to post copies of correspondence with your IP on the forum. We do not have detailed knowledge of your case, and it would be wrong for expert posters to comment on another IP firm's work - without full knowledge of the facts. If you wish to compla...

I am not too sure, but I will stick my neck out and say that as long as you remove names, addresses, phone numbers or any other contact details then it should be ok. I'm sure Andy will delete it if he doesn't agree with me! Hi Jan, What I'm really looking for here is some advice as to whether the C...

Hi everyone, I've now had a written reply from CCCS re my formal complaint and there are a number of things that i'm not happy with in it. I would like to copy and paste this reply in this post to get your expert opinions on the statements that the CCCS are making, but before I do, I'd like to confi...

CCCS is here to offer advice to individuals; the ultimate decision is up to the client which route they would like to take. Whatever route a client chooses to take we can guide them through the process. Regards CCCS But surely all options should be discussed and explained to the client whether they...
