What legislation allows creditors to just sit on their security...? and then say 10 years later for the sale?????

i dont think this is allowed?......

this is not illegal if done properly.....

i am not saying to do anything illegal.....

What I am saying is that get three current proper valuations to find out exactly what the property is worth...

Dont forget, houses at auction dont sell at full market value....

Hi, I would try an IVA first, if you can afford it..... However, some companies wont accept anything less than at least 40-50p in the pound. If you had no equity in your house, it probably would be more straightforward..... You could transfer the beneficial interest in your home to a parent or someo...

Melanie,

You have misunderstood my post.

All I am asking for is a clear piece of legislation, that would enable a judge to remove or set aside these CCJ's

Obviously, nobody knows of any and therefore, why would a Judge set aside or remove???

You have to understand that giving a reason because so, and so said on a wesbite may not cut it with a Judge.

If you cannot help and provide the legal reason, then I will ask a Solictor.

I agree,

But again, the Judge will want to know what law I am saying enables me to insist that the CCJ be removed because I was in an IVA?

The court form is an N244, but whats the legislation?

I disagree,

Check through the legality of these notices, as once lodged on your credit file, you will face an almight battle to get them removed.

These are just as bad as having as many Bankruptcy Orders on your file!!!!

After an IVA and BR, This is my new nightmare......

The courts have told me I need to make an application using an N244.

This is why I need the EXACT LEGISLATION.
