Thanks for your comments. I anticipate this going a slightly different way. I would be glad to hear alternative views. 1. The debt was post IVA. The liability order will be obtained post IVA, so it seems to me that inclusion in the IVA is not a possibility. 2. Merlin's link was most informative. It ...

I am some way through my IVA. I was a bit surprised to receive a demand for council tax on a property which I once owned, subsequently repossessed and sold. The council tax demand is for a significant sum and I did enjoy some exemptions ( empty ++ ). There are no other reliefs available to me. The c...

Where a person happens to be in an IVA, not much of the 5 year + process feels like a "rush", mostly the clock seems to tick very slowly. Given we are in a society where credit is important, for instance to business people whose normal practice is to borrow in order to operate ( buy to let landlords...

A question of property and mortgage lenders who repossess. In the case of property repossessions which occur ( half way ) through an IVA, the associated debts do not crystallise until a sale ( to a new owner ) and this sale event brings some certainty to the any shortfall amounts, and how much a len...

Kazza All good suggestions, I had a look at Vanquis and that certainly seems suitable for purpose. I know you said you would be waiting, but to me it begs one question - where you can only ever get £200 max credit with your IP's approval, would that, theoretically, provide a platform for a Vanquis c...

Thanks Paul.

Where you mention contract phone perhaps that is a good example of a small thing which could help one start to build up a picture. Recently I had assumed I would not waste time applying for a new contract phone as given the requirement for a credit check . . .

I thought I had covered the need to agree this with the supervisor in my earlier post " conditional upon receiving the consent of the supervisor. " - sorry if I didn't make this sufficiently clear. One model suggested to me, which might work, is where a person subject to an IVA, but wanting to get b...

Thanks Liz. I know of at least one person who has succeeded in obtaining a new line of credit. To sit back and wait until an IVA has finished might not be the best thing to do if there is a way of starting up, in some mall way, a positive credit picture before then. You make good point about removal...

Perhaps I was unclear with my original post. The obvious point is that - as a current snapshot - someone in an IVA will fail to enjoy a credit rating of any use. I am not sure exactly what happens at the ( successful ) conclusion of the IVA, perhaps if an IVA sits on some sort of credit system, perh...

Each year during an IVA one is required to submit an account of income and expenditure.

In the event that in one year there is insufficient income earned to make up the IVA payment contributions which fall due, I wonder if there might be any issues for a person to receive help from friends/ family?

People in IVAs cannot take any form of credit without the permission of the IP - which is unlikely to be granted in your example. If the financial position of someone in an IVA improves at any stage during the IVA, from whatever source, they can expect to contribute more into the IVA - so if there ...

Sorry if I was not clear. The spouse making the loan is solvent, to be properly regarded as unconnected with the ( my ) IVA in any way, other than by marital relationship. To be clear, solvent partner making a loan to partner subj of an IVA, the latter then goes on to make some capital gains profits...

Supposing the circumstances are that an IVA has been approved and working satisfactorily for a few years, with a few years to go. Suppose that debt problems were less pressing than they might have been at the time the IVA commenced. 1. Can a person in an IVA make use of his / her CGT allowance ( c. ...
