I am sorry to hear about your split and I can only echo what has been said so far... you need to speak to your IP as soon as you can and explain what has happened. You also need to speak to your mortgage company and try to come to some arrangement to pay back the arrears.

As Jan said, you would be asked to pay that into you IVA. At Payplan we can look into offsetting theses funds elsewhere in your budget it needed.

Yes of course you can. If the payments change then you need to notify your IP so that they can make any necessary changes in your expenditure.

Due to the current housing market it is getting harder to estimate how much a house will sell for. We prefer to wait until we get confirmation of all debts before proceeding with an IVA as should the estimated level of debt increase by more than the percentage allowed in the proposals or modified it...

kallis, it usually depends on the circumstances surrounding the case. As a rule, if the house is on the market we would wait until it is sold. As a rule we do need to know the amount of the shortfall to allow us to put this in your IVA proposals. As it is now an unsecured debt we require proof of it along with your other unsecured debts. I would say that if you have a mortgage shortfall then it must be paid back, if it before the IVA then it will be included, if not then you must come to an arrangement with the lender. Some IVA's have claus to say that if you cannot raise the equity, you will make an additional 12 payments into the IVA. Meaning it will last 6 years instead of 5. Double check your chairmans report to see if it is in their, otherwise double check it with you IP.

Poor man! It can sometimes take a while for the IVA to be passed down to the people who actually need to know. I would have thought that it would have for you by now. Worth letting your case officer know.
