Hi David.md,

You are entitled to keep your statutory redundancy money but anything above this will need to be paid into your Trust Deed for the benefit of creditors

Hi aka_carrot,

As the Mortgage is in joint names then her half of any potential equity would be looked at in year 5 of the IVA.

You could not transfer to your name as it would be classed as Disposing of an Asset by your wife and they can check back up to 5 years.

Hi Jo,

Kallis is spot on as to open one quickly, but have you checked T&C's with HSBC, worst they can do is close it, they might be understanding about it, but no guarantees.

If you have been offered a loan at this rate then your credit score may be a bit lower and hence the reason for the APR of 25%. I agree with Foggy and it is on the high side

Hi s.b.w,

On any forms it should ask you for example: In the last 5 years have you been declared Bankrupt or other Insolvency Solution. However it could vary between lenders on how many years it would ask for.
