I don't think it was an honest omission - they just didn't want it including. I *think* (but couldn't swear to it) that the IVA administrators are aware of it as it was mentioned in a conversation to me about 2 years ago that they may have to include this loan (and the individual then wanted person ...

Thanks guys.
It wasn't disclosed as they didn't want another creditor on their IVA and they didn't see the point as the other person was paying it in full.
The outstanding amount of the missing loan as at this month, is roughly the same as the total of the other debts included at the start of the IVA

Hi I wonder if anybone would be able to advise on this situation? I'll try and keep it simple. Person A and person B were married for a number of years and owned a house together as well as a joint secured loan, a joint unsecured loan and a few debts in individual names. They divorced 3 years ago an...

Thanks guys, but how can a joint 'windfall' be taken and used against something that has nothing to do with me? So if I would have been the first named person on the policy, I would have got the money and it wouldn't have gone direct to the IVA administrators? Surely that is sexual discrimination (C...

Hi It was a joint asset though - not just his. He got the house, contents and car, and I was to get the cashback. The loan is in joint names. We had to apply for the cashback once the policy had matured - I did this, and they sent me a letter to say that a check would be sent to the first named poli...

Thanks for your help guys

I jumped the gun a little I think. He hasn't had the money from the loan company after all - they paid it directly to the IVA administrators!

(I have started another thread with my new question on)

Many thanks

Hi - I have another question sorry My ex and I have a secured loan, which he has been paying since I left 2 years ago. This year a cash back amount was due on this and was to be mine as per a consent order/divorce agreement. My ex now has an IVA which has taken care of all his other debts. The loan ...

Hi Thank you to everyone who has replied. I'm not going into bankrupcy lightly, but I really have no other choice. I will be going on maternity leave in the summer and my income will reduce to SMP only. (I was due some cashback from a loan at the beginning of the year, which would have paid my debts...

Hi Thanks for your replies It is an unsecured loan. He didn't include in in his IVA as it is in the consent order stating that I will pay it. (Although it also says that he will pay all the other loans, but as he started the IVA they have defaulted to me anyway). I am considering going bankrupt, so ...

Hi
My ex husband is 2 years into an IVA, but he didn't include a £20,000 joint debt. Should this have happened? I have been paying it for 2.5 years, but I am not in a position to in the future.
Many thanks
