Please don't get me wrong as I am not trying to shirk my responsibilites but hypothetically could I just start repaying back Max Recovery through Fairfax and wait for the others to contact us - if they ever do? Or should I make an effort to contact them? Sorry for the questions but my head is spinni...

Thank you for your advice. I don't think our IP firm (Grant Thornton) offered us much advice as my husband was out of work and I had a second child on the way and it was basically, you can't afford to pay it, no point proposing a variation so they proposed to terminate it. Thanks for the link Kazzaf...

Bit of a lurker but in need of some help please? Our IVA was terminated as we could no longer afford to pay due to our circumstances. Our financial situation has improved now. Our problem is that we are being pursued by Fairfax Solicitors on behalf of Max Recovery (Barclaycard/Mastercard) for the ou...

Thanks for your replies. Plasticdaft - unfortunately nothing was done about the debts after the termination, probably due to the old head in the sand issue that and I suppose because we never received the official notice we were keeping quiet. So we are back to the drawing board and I keep thinking ...

Evening all, I hope you don't mind me posting as it been a good few years since I last posted (sounds like I'm in the confession booth) and this forum was a godsend when we first entered into our iva. I'll try and give you the brief version of events. Our joint iva commenced in April 2006. In July 2...

Our IVA was terminated because we had a dramatic change in circumstances ie new baby, hubby had to leave his job and I'm now only doing part-time hours. We had proposed a variation to our IVA but because we have no disposable income left each month it was rejected and resolution 2 - Agreement to ter...

Well I rang GT this morning to find out a bit more further to the termination of our IVA (although apparently it will still take 8-10 weeks for the certificate to be issued). I'm quite disappointed in them but hardly unexpected. When questioned about the fact the they retain the funds to petition fo...

I am going to contact GT in the morning but wanted to get things a bit straighter in my head. Having checked our initial proposal it does state that GT should retain sufficient funds to petition for our bankruptcy should the agreement fail by means of default but will try and get some clarification ...

Evening all, I haven't posted on here for quite some time now but found this forum invaluable when we first entered into our IVA in 2006. Since we entered our IVA our circumstances have changed somewhat substantially. We had to move in July 2008 and shortly after that I found out I was pregnant. All...

Melanie/David - thanks for your offer of help - I shall let you know if that is ok. Emailed them today proposing a 6 month payment break starting at the end of January (to cover the dead car issue) and to re-contact them at the May with our revised I&E. They said they will draft a proposal to put ou...

Thank you Melanie - I will put this to them and see what they say. I know that we would rather see the IVA concluded one way or another rather than failed.
Thanks for your advice.

No - I sent them an email about 4pm yesterday but someone did get back to me today. He said that they would take the child benefit into consideration which would reduce our negative surplus by half and that my hubby was earning more on his payslips than I had put down. I did explain to him that hubb...
