Once your files are clean there is no reason why you or him couldnt apply for credit. It would however largely depend where you apply for credit, and you should avoid attempting to get credit from anyone who was a creditor in your IVA - as they have their own records to look upon. If its a non credi...

Just thought I'd let you all know I have finally received my completion certificate from GT! It took just over 11 months from final payment and the cert is dated 4th July! My very own indepedance day! I achieved a 60p/£ dividend on a debt of around 64k so not a bad return, slightly higher than the f...

I would say around 2 months after the variation meeting took place is the norm (the first 3 weeks after the meeting they cant do anything as there is a cool off period for creditors to change thier mind). Then add 4-6 weeks for GT to finalise the closure documents (they have a lot to get through, ap...

Another awful story that quite frankly makes a mockery of IVAs and the 5 (or 6 in some cases) and be debt free claims. Its written in black and white on most policies that the IVA must not run longer than X months and must be closed within Y months yet this is simply ignored so creditors can claim t...

6 years should be 6 years and that is the rule. Either the CRA or Creditor has a case to answer. At least making complaints to the above bodies alerts them to the fact it is happening - if nobody complains the creditors or CRAs then dont care as they'll be able to keep getting away with it. Obviousl...

I'm no legal expert but it probably depends what you stated in your letter - if you're being defamatory then maybe there could be a case (IE along the lines of: slanderous, insulting, abusive, denigrating, disparaging, vilifying, derogatory, injurious, libellous, vituperative, calumnious, contumelio...

Keep checking for sure and if it keeps happening then do complain with one of the bodies I posted earlier in this thread as neither the creditors or the credit reference agencies are allowed to do this. Keep a log of the credit ref agency, when it happens, and what accounts it involves so you can gi...

Not sure if I can post a weblink here but if I can then you can find their complaint process below: http://www.experian.co.uk/assets/consumer/contact-us/complaint-handling-procedure.pdf Clearly state your reasons for complaint and I agree they should remove it without the need to see your certificat...

I believe your IP should set a deadline for claims to be received after which the creditor is no longer entitled to a dividend. So might be worth asking your IP when they contacted the creditor to establish the claim and what deadline they have given them to respond. Btw, I also believe the IVA will...

Ask them on what grounds they think its live? I presume it isnt on the insolvency register anymore, in which case they should remove it from your records. If you send in your CC be aware they might remove the IVA from the insolvencies section, but might add a notice of correction to state when your ...

I keep reading that equifax are adding a notice of correction to state the date when a persons IVA had completed. I believe when a NOC exists on a persons credit report that a creditor is then obliged to take note and obviously up on seeing this information, they would normally decline the credit ap...
