Hi Cockerhoop. Not sure of girls name that rang me that day but certainly sounds like her although my IP is called Emma and I think it was a junior member of staff who called me. Melanie - Re the opportunity of 14 day adjournment to consider modifications....first I've heard of it! However, can't ch...

That is what I thought but getting confused by your previous posting. You talk about Supervisor being apointed by creditors and therefore responsible to them. Yet if the Supervisor and IP are one and the same surely the debtor chose them and are ultimately paying them. Also you say they are responsi...

Sorry Melanie, one more question. Regarding the IP's position working for both the creditor and the debtor. If their responsibility to the creditor is to get as high a return as possible (and I am happy with that) then what is their responsibility to the debtor? Because surely by collecting payments...

Unfortunately, as most people first looking at an IVA can only take an IP at face value and do not have any experience of the possible pitfalls they are, therefore, usually already signed in before finding them out. At that stage it is too late. Compared to a lot of the postings I've seen on the for...

I met someone (IP possibly? but not my supervisor) at initial consultation but from then on, all preparation was by phone. Have never spoken to Supervisor and on day of proposal meeting I received a call from one of her assistants to tell me that IVA had been accepted but that there were a couple of...

Thanks for your replies Melanie and Andy. I have no problem with the creditors wanting as good a return as possible but I do now feel that things are 'sold' in a vague way. eg it is commonly stated that the IP costs are included in the arrangement giving the impression of 'don't worry, you don't nee...

We have exactly the same 4th year equity release clause in our iva. Exact same wording! And it wasn't fully explained to us either. To be honest 'on the day' when waiting for that call to say whether iva has been accepted or not is nervewrecking and it is such a relief to hear a positive result that...

Thanks Melanie. It's great to be able to get some expert advice in an informal way before approaching my IP. I was under the impression that the equity clause only really kicked in to the amount that we could borrow through a re-mortgage. I did not realise that we could be forced to sell to release ...

sorry...exact wording should have finished with 'to be paid by way of ongoing contributions for a period of up to twelve months.' A couple of questions after your last post... Would a higher offer be more likely to be accepted? If we were offering a cash payment by way of a loan from a family member...

Exact wording is 'Property is to be valued shortly after the fourth year anniversary of the arrangement and 75% the debtors equitable interest to be realised and paid to supervisor before completion of the arrangement. If necessary the arrangement can be extended to to allow an equivalent sum to be ...

Property increases have been very good in our region. We haven't had a valuation but I would guess in the region of £180,000 with our outstanding mortgage just over £100,000. Our joint gross incomes are £24,000 so I can't see how we could increase our mortgage even with the equity being there. Can w...

Hi everyone. This is my first post but have been in forum for a few weeks now. So much information, I wish I'd discovered months ago! We've been in IVA since feb 2006 so a quarter of the way along the path to debt free life already! We've been reading with interest some of the posts re offering earl...
