Well let's see what happens today!
I have written to my supervisor agreeing that his requested amount is placed in a clients account at a solicitor.
I am working on a variation and I will make a monetary offer to try and reduce this statutory interest figure.
Let's see what happens!

Hi Kellym Might be a good idea to wait a week or two and see how the job offer goes and then you can start to sort out your income and how much you can afford. You would need to consider the rent on the shop in your outgoings. Just a further thought from the taxation point of view. Has your business...

The offending clause! "In the event that it appears to the Supervisor that there are sufficient funds to make payment in full of the debtor's debts, together with statutory interest at the prevailing rate, and the fees and associated costs of the Arrangement, he shall do so expeditiously and in the ...

Please go through your IVA document and look out for any clauses that state statutory interest.
Please come back because we have a major problem. I will get the wording and post it on this thread.
Please do be careful.
Good luck

Before you rush off can I ask a quick question please|? If the shop was a partnership or on sole trade terms then it might be possible for an arragement to work as IVA's can be flexible. There is no difference between personal and trade debt when it comes to an area like this. Basically I had a simi...

Thanks Andy
Can I though write what I want to say to my creditors rather than using him to write it for me. At least i know what I want to say rather than using a third party?

Further thought would I have a better chance if we offered say £3,000 to £5,000 of the variation at least we would be able to keep 75% unlike 50% which would happen if we don't go for the variation. Can I organise my own variation meeting as I do not really want my supervisor to do this as I have lo...

Oh Dear!!!!! Basically there was an equity clause and so it looks as though we have lost. Many thanks for the source I haven't heard about the Judgements Act 1838! As regards the variation I was told it would cost £600 and there was little chance of the creditors agreeing to it. Not sure we should r...

I managed to obtain a Halifax Easy cash account with Visa Electron card and this does the same thing as the Co Op cash minder account which I also have. Another one to consider for using for shops is CashPlus Master card which you pay in and can use for places which do not accept Visa electron. This...

Perhaps the question is:-
Can Banks charge interest and charges if you are 19?
If that is the case then the answer is yes because you are no longer a minor ie child.

Hi Helen I can echo what others are saying. The rules for debt collection are strict and they can not turn up to your work place as this is called harrasement and there are quite strong laws against this. Perhaps the only thing they can do is call you at your work place by telephone if they have a n...

Just scrolling and having a look at S263 which is an interesting bit of legislation and what does this actually mean and what can it do?
Obviously in some cases a judge would look at things slightly more sympathetically than a supervisor or creditor?

My wife and I are in an IVA and after a lot of difficulties we decided to sell our home and make a 100% payment to our creditors and the supervisor fee. We decided to do this in November 2006. We requested the settlement figure from our supervisor and was informed that it would be £60,000 and this w...
