Hello Melanie Thanks for the in-depth reply. I think he would certainly be better going for bankruptcy as he has no assets. Personally (and don't shout at me please anyone) I think the restrictions it would place on him would really help him long-term. He just cannot get his head around using credit...

Sorry - I wasn't suggesting he SHOULD increase his debt, I simply put forward the notion that he would be better off if he had £10k more debt.

I was expressing my shock at the way the system appears to work.

Thanks for the advice, so far !! I must admit to finding it rather strange. It would seem that he can have a debt of £16k and pay £180 per month for 7yrs 6 months. Zoe - the "report" he had back from CCCS suggested a Debt Management Plan, which would mean the debt was spread over nearly 8 years (rather than 5 with IVA?) and there was (I believe?) no guarantee the creditors wouldn't later sue etc anyway.

You manage to sum it up better than I could even try - it seems anything I say is interpreted as anti-IVA and that is certainly not the case.

If that was my attitude, do people think i would bother coming on here to try and assist my step father ?
