Ok I understand the word apply is different to the word accepted . But I was taking to account that would you really need to give the creditor an advantage over bankrupcty for the IVA to have a good chance of being accepted ? you do get the odd good creditor but generally speaking you and I know the...

If your equity exceeds what you owe then i would say yes . If its roughly the same or less then you may not have to as the as the creditor would have to take in consideraton court costs and a forced sale valuation !

The credit card charges are not included in the Ruling and you claim the full amount back even IF its UNDER £12 .(this is because the OFT ruled that £12 or over they would investigate this does not mean they arer ight in charging £12!!!! SO Go ahead with your claim for the full amount !!!. Also it i...

The difference between a BRU Bankrucptcy restriction undertaking and a BRO Bankruptcy Restriction Order is basically down to whether you accept the OR findings(BRU) or decide to appeal against them (BRO). I recenly had a case where a BRU was overturned on the basis that the debtor had sent a copy of...

Agreed , Chartered accountants ,in my experience are normally ok providing that there no evidence of impropiety (byelaw 7). Yet certified accountants can lose there position due "to bad financial management" (byelaw 25) Company accountants (CIFA Article 21- 22) , Financial accountants(CIFA Article 2...

Hi Well done to admin & co to uncovering the fact that there may be unscrupulous people out there emulating official bodies that are offering impartial advice to people in IVA's . However I do not agree that the the Insolvency register should not have the information displayed Firstly, you would not...

Hi Deborah It seems like you have had a raw deal here! The fact that you haven't paid anything into the IVA, coupled with the fact that the company does not seem to be bothered to contact you , suggests to me that you may have been given bad advice about entering into an IVA in the first place . I w...

Hi Hallway I would need a bit more background on your relationship with your husband . Some creditors can argue that all though the debt is in your name soley he may well have benefited of the debt and should therefore contribute toward the repayment . But if let's say you already had the debt befor...

Hi Zoe Just Reading your post about MBNA and them not getting money in an IVA. Presumably this was advice given to you by a 9 yr old in Delhi working from one of their call centers and not a debt recovery agent who is suitably trained ,old enough to know what a credit card is and able to adhere to t...

Hmmmm Could be new tactic on their part. I wonder if the fact you said you would go bankrupt if it fails will influence their vote ?????? Hopefully they have started to look at numbers and will begin to soften their current stance on IVA'S Good luck I had a phone call from MBNA last night, was think...
