I also am of the opinion that it would not purely have been on the basis of high fees. The IP acting on your behalf should have explained to you the reasons for rejection. On receipt of the rejection proxy I would expect him / her to have contacted you to explain the position and between you and the...

I'm not quite sure what Accuma's problem is here, but I am also not familiar with the ins and outs of your IVA. If you have asked for a meeting of creditors to be convened, then the IP has a responsibility to do deal with that request and convene a meeting. I wonder why Accuma are now questioning yo...

If you are considering offering full and final settlement to your creditors, the amount you are proposing to introduce will be on top of what you have already paid. I'm not quite sure I understand the information you have provided here - Original Debt: 17K IVA: 13K Paid Off: 3K Monthly IVA: 230 I ha...

If you have only spoken to one person, then my advice would be to seek two or three other opinions. You will not be able to gauge if the advice given to you already is impartial unless you do that. In bankruptcy, although the house might have negative equity, the Trustee will still seek to realise y...

Assuming you get automatic discharge from your bankruptcy, I don't think there is really anything that can be achieved until you have confirmation of that discharge which you can then forward to Experian. Your bankruptcy will remain on your credit record for a period of six years from the date of th...

Basically, someone in your position should have each of the available options explained to you. This should include the respective advantages and disadvantages of each of those options. It is then for you to decide on what course you feel best suits you. In discussing those options, the other person...

That could all depend on whether you have a main residency or center of business in England and Wales.
If not, then I believe the answer is no. Doesn't Guernsey have it's own Insolvency Laws?

Yes, all IVA's and bankruptcies are recorded on there. It is not your responsibility to ensure that your details are recorded on the register, it is that of your supervisor. However, given that the arrangement was approved in October, I would have expected the details to have appeared by now. It is ...

It all depends on who votes on the day . Generally it can be said that any creditor voting on the day whose liability exceeds 25% in value of the votes cast that day has a casting vote. It does not necessarily have to be one creditor. A representative, such as TiX or KPMG might act for more than one...

The IVA will stay on your credit record for a period of 6 years from the date that it was approved. There is nothing to prevent you from contacting the various credit reference agencies and asking them if there is any way that you can have your credit record reflect that the terms of the arrangement...

Whats to stop the companies just adding more interest on when the end is in sight again?? I really cannot see why anyone would enter into a DMP where no one has to play by any rules.(except the person in debt!!!) That is an interesting point. I'm not familiar with the workings of a Debt Management ...

The debt does not die with them.
The debts would become due from the estate of the deceased and unless I am mistaken, I believe the debts take priority to the beneficiaries of the estate.

It is also worth pointing out that there are certain creditors who will NOT support an IVA if the debt has been incurred relatively recently. Further if you openly suggest that you are considering doing such a thing and are subsequently made bankrupt ... you're almost certainly going to be up in Cou...
