Thanks but the point is I have not been told my completed IVA file has been passed to another IP company. The letter from the ppi claims company says cleardebt have passed my details to them. Are you saying that all closed cases are now with another firm? If so should I not have been made aware of t...

I have the same. I am sure I read cleardebt were no longer trading but have been in contact with David Mond who confirms they are still trading. My concern isnt about ppi - it is what it is and I know its not mine but more that:- 1. Near the end of our IVA cleardebt employed a claims company who wer...

Goosed, yes they are so really important that Timberwolf asks for a copy of the paperwork. If they have said there was agreement this is fraudulent and needs investigation pronto.

Hi timberwolf. I too have been a lurker for many years and found this forum an excellent place. It seems on other sites this isnt unusual. However read debtcamel. Your t and c's cant be changed without your agreement and it sounds that you have been duped. You need urgent legal advice and the best p...

Hi Foggy, there is a need also to see what has been the norm - I.e how this clause has generally been interpreted in the past and this is what the court would look at when dealing with a contract dispute. Now dont get me wrong and think I am trying to encourage disputes, I was in an IVA, and have no...

I personally think there wasnt confusion on the wording but a new way to increase return has been thought up so protocol changed . I suppose one should look to what has been the normal practice with these clauses pre 2014. I had no discussions with my IP re secured loan and wonder about others who c...

I dont think this is open to interpretation by the IP. Protocol was changed in 2014 to include secured loan so it seems to me that is was not included in earlier protocol. As the IVA is pre 2014 the new protocol cannot be applied as has been clarified above. Therefore the options are remortgage, int...

Hi Michael. This isnt about keeping a firm afloat surely, it is in relation to whether the persons IVA is drawn up specifically with the relevant clause (s) which allow for a secured loan. I think if people were to check, that the majority are not and if so, any new prorocol or regs that deal with s...

I think that is the way we all feel when receiving letters saying do this or we will consider making you bankrupt. Most will go on and do as asked without complaint because they feel there is no option. Ppi is the same and as each IVA is individual it is important to check every one individually to ...

You absolutely must seek independent legal advice before agreeing to anything. You should not be put in position where affordability through mainstream lending would mean you could not take a loan but through sub prime means you can surely.
