Am i doing right if in the meantime I apply for a variation of the monthly instalments of the judgment? Apparently I can do so within the next 16 days filling an N245 form. I mean I have to explain to the judge that according my income and expenditure I cannot efford to pay £314.39 just for RBS debt...

I just wanted to make you feel less lonely at 4am in the morning and cannot sleep because debts. I am going through hard time myself. Yes it is on the market. Unfortunately it is not a big business so I will not realize lots of money from the sale. Like I have said if I will be lucky it will be between 15/20k. But I cannot efford to repay 100p per £ anyway so I guess I have not got much hope to have my IVA accepted.

Thanks for your help. I will keep posting how I am getting on so I might be able to help others. Can I ask you one more question: Based on what I previously asked, how much would RBS dicision to gohead with the charging order or agree to an IVA be influenced by the abilities of the IP?

I have not probably explain that well. The IVA is in joint name: mine and my partner. The house is in both name but the RBS debt is only on my name. £250 is the reasonable amount that I feel we can effort confortably for the next 5 years even if events will be against us. Ok, I was going to propose £250 a month for first 48 months, last 12 months £380. I have also have a business which is for sale and once sold I will be left between 15/20k and I offer them that. So what do you think is best for me to do. Mccambridge duffy seems a good company and i needed the past 2/3 weeks to put documentation together. Evenctually I cannot agree most that time is not on my side but is there any chance that I can get out this mess?

I just received today the judgment for claimant from the court. It says that the defendant did not accept my monthly offer of £40 and I should pay instead monthly instalments of £314.39. First instalment due the 04/10. I am assuming that they will gohead with the charging order if I wont pay the ins...
