Not necessarily- I would expect your second charge to have remained there notwithstanding you were in a repossession situation. Are you sure it was secured?

Thanks for all the posts/ queries.... Andy- yes I probably did mis-read your post. I assumed that you were referring to sale charges in a positive equity situation. Melanie- thanks for the heads up. I would be interested to know if any of the traditional sub prime lenders prove or not? Can you name?...

Ooh lovely question and one which I can give a lawyerly answer to..... it depends! There is indeed a 12 year period but, with the law being the law, there is a general contradiction that recovery under contract is time barred at 6 years. The lenders currently, and successfully, argue that they have ...

Speak to the OR and take financial advice. You are probably aware that there are several types of policy- some of which have little surrender value, but others have considerable worth. In the long term (assuming it is a growth and not a flat policy) you will probably be recommended to maintain payme...

Morning There are few issues raised here so hopefully I can help with some.... 1. Welcome (who I tend to have little pity for generally) will get their share in the equity directly from your first Lender. Case law requires that Lender to obtain full (or as near as possible) market value as they are ...

Hi Mollie This is a more frequent concern then people realise so you are in good company in raising it. You will accrue rights in a house by virtue of your occupation but the legal ownership will remain with your parents and your personal debts will not taint their ownership. Melanie's advice on dis...

Andy I agree that mis-selling is an option and I also question how the lender argued the "loan into retirement" question from an underwriting perspective BUT it is possible that the PPI was a 3 year term policy perhaps? Hi Kath- and welcome.... can I ask who the Lender is and the purpose of the loan? Was it secured on your home or the business assets, and did you take out any personal guarantees?

I think Johnz comments are spot on. This industry is bedevilled by hidden charges and false promises (or such I would argue is the perception) and it is somewhat refreshing to have a candid and open approach to fees and service levels as shown by Andrew. I am looking to place DMP's in the future and...
