The other option I guess is that if your husband's income is now less than when you started the IVA - and there is no equity in your property - is whether bankruptcy would draw a line under this? But do take further advice.

I agree with Foggy - you can't leave debts out of an IVA - so the joint loan would have to be included and that means the lender may well contact your husband about it. Thank you for your Forum question. I think it's highly unlikely the debt could be covered by a completed F&F IVA. Possibly if its a very small debt but I guess this is unlikely. Better I suspect to try and get to the bottom of the HMRC potential debt first.

He can't be asked to sell the property or move out. Or to pay a lump sum he doesn't have. As Foggy says its equity release or potentially 12 months of extra IVA payments.

I guess the annual review will still happen if it falls due (ie 1 year since the last one). As Foggy says - all terms of the IVA still apply. But very good news on the equity and the end is in sight!
