Hi Teresa, No you would not be able to exclude specific creditors from an IVA, part of the Arrangement would be to treat all creditors fairly and why should a few of them write off debt whilst others get paid in full so they would all have to be bound by the IVA. As Tina has suggested, you need to l...

Normally there is a delay (i would say no more than three months) from approved F&F to completion to allow time for the creditors to submit a final claim and the IP to distribute the money, as it has been five months you should ask for a progress update. Letters are not unusual following an approved...

You will find (as Andy Suggested) the fee's are very standard throughout the industry as they are dictated by the creditors and regardless of which firm you choose the fee's once approved will all the the same. There are a handful of company that will charge 'set up' fees if you are asked to pay any...

Hi Paula, the restriction is there to protect your creditors interest and to prevent you from selling / re mortgage the property without the IP's consent. If you are looking to sell the property to the hosing ass to free up some disposable income in order to maintain the payments to the IVA and ther...

Hi Paul, The IVA protocol does now have provisoins for this so i would suggest that yes you would be expected to pay 50% of your overtime into an IVA. You wouldnt be expected to stop your pension but there are restrictions on what you can pay in to it, noramlly if you making just the minimum contrib...

It would have to be disclosed to your IP, however depending on the amount you inherit it could well be worth discussing with your IP using the money as full and final settlement of your debts and bring your IVA to an early conclusion.

I Agree with Melanie, assuming it does happen it something totally out of your control and dont see why you should have to extend your IVA. I would probablly suggest a variation in order to reduce your payments for the remaning term.

I am very surprised the other creidtors who did show up at the meeting agreed to IVA as they would have known that CSA arrears are not bound by an IVA and like you say without the arrears you would not have needed an IVA !! Have you been able to speak with your IP directly ? Which company are you wi...

As Michael says IVA's were originally designed for the self employed but became alot more widely used. If he owes the Tax man money then this debt would need to be included into the IVA and would be taken care of as well. HMRC are normally very supportive of IVA's the only time they have an issue is...

There is no obligation on your part to pay any overtime into the IVA pre approval, and if anything it makes sense for you to use this money to buy these essential things before you enter into the Arrangement. Creditors dont actually look at the bank statements, it is your IP (or his staff) who carry...
