Melanie is quite right For someone to suggest that an offer of 45p in the £ for an IVA is too much is utter rubbish. In an IVA, you are meant to offer as much as you can. If this means 75p in the pound, then you would have to offer it and the creditors would be happy to accept. I note, you have an H...

Its always difficult to know exactly why the judge ruled as they did in these cases. Often the information reported is scant and we do not know the whole facts. I understand that there are many thousands of people who have successfully reclaimed bank charges and I am sure that the banks have fought ...

Mel.d If you do decide to go done the DMP route, then yes, you absolutely should include all of your debts. If all of your Disposable income is being used to pay the creditors in the DMP (which it should be) then how would you afford to keep paying the other creditors? I hope your call with Thomas C...

Sue As Mel says, you have to go back to your IP and get to the bottom of it. If you have an agreed and signed IVA which states you need to release £13,000 then this should be it. I am interested to know how you got away with this though. From what you say, you seem to have £40,000 equity in the prop...

I totally agree with Andy's point here. We seem to be in a situation where many creditors are of the opinion that debtors will just not dare to declare themsleves bankrupt. In that environment, creditors make what might be seen as unreasonable demands in the knowledge that if they are not met, the d...

This sounds like an interesting stance from Morgan Stanley. At the end of the day, under the terms of your agreement with them, they are allowed to reduce your credit rating at any time. However, once your IVA is accepted, they will have to stop charging interest anyway. James Falla Expert in IVA, B...

Louise, If your creditors meeting is in June you have nothing to worry about. Even if MBNA apply for a CCJ, you have 14 days to respond to the letter when it comes through - you will recognise it as the forms are official looking and blue in colour. You should ALWAYS complete and return these forms ...

Lisa Having read all the comments on this post, please will you remind me if you have a property or if you and your husband are renting? If you are renting, then I think by far your best solution now is bankruptcy. You owe £19,500 and even if you pay £280 per month and 100% of this goes to your cred...

Mel.d Really if you are comparing IVA or DMP, you shouldn't be getting hung up about your credit rating. The first thing to think about is resolving the problem. An IVA will get the debt settled in 5 years. After that no more debt. A Debt Management Plan will take as long as it takes to pay off 100%...

Mark Some good info already given about the house here. I would add to Melanie's comment about the car. I deal with a lot of bankruptcy cases and I know that the OR's office has guidelines to consider cars over over £1500 in value. However, if you have a more espensive car, you will not always autom...

Hi d_m Debt Dummy is quite right. Unfortunatley secured loans can NOT be included in an IVA. You might like to consider speaking to a mortgage broker about consolidating both your mortgage and secured loan into a single mortgage. If possible, this could work out a lot less expensive for you each mon...

k_m I would definitly speak to Synergi and get a straight answer from them. If the payments you are making before your IVA is accepted are not going to be part of the IVA, then at the very least, you should have agreement from Synergy that they will be refunded in full if the IVA is rejected. Hi Pcc I agree with Melanie. It sounds like your IP is acting extremely unprofessionally. Who calls you? Is it the actual IP or one of their staff? I would be inclined to call them and demand to speak to the IP directly and ask what is going on. James Falla Expert in IVA, Bankruptcy and informal Deb...
